Joseph What is going on up in Washington Stae? Last night, mon, someone ambushed 2 more sheriff deputies, thankfully the officers were'nt killed and they managed to kill the suspect. Being a regular citizen, I often wonder if law enforcement needs more leeway to do their jobs. This is getting insane.

Steve Rothstein I just saw the new poll on the magazine web site. The poll asks about search warrants and cell phones. I have to admit I have to read the court ruling to know for sure if they ruled correctly (the way I think they should) or not. If the search is incidental to a legal arrest, I don't see why I need a warrant. I can go ...through everything else they have on them at the time, whether related to the crime I arrested them for or not. The cell phone should be no different.

But if we are talking about during a stop of a suspicious person, then I can see needing either a warrant, exigent circumstances combined with probable cause, or consent. I might be able to pat them down for weapons, but I cannot search other things they have so I shouldn't be able to search the phone.

Basically, I don't care if it is a phone, computer, briefcase, luggage, or notebook. It should not make a difference to the search in most cases.

Once upon a time you had to use your radio to run subjects for wants and warrants. Now, you can run as many subjects as you want. As if that wasn't enough, license plate recognition systems can alert you for warrants.

I agree that certain newer investigative techniques have made aspects of the job easier, but the legal minefield and the bleeding heart Judges seem to get worse by the day.
