it just makes more sense on so many levels to help drug-addicts get better. not only do they save tax-payer money by not being in jail, but if they get clean then they can become working citizens again, stimulating the economy. duh duh duh, why is it taking so long for people to figure this out??

While I don't disagree Lisa, I'm not sure I have that much faith in Rep Maestas. For one thing he's not telling the whole truth about punishment in NM. It's max 15 days jail for less than an ounce, a full misdemeanor for up to 8 oz and only a felony for more than that. I'd also want to see the fine print on that bill. Few district judges in my ... See Moreexperience practicing law in NM give significant time for 4th degree felony possession if there's no prior felony. If this is just mandatory drug treatment added to the other conditions of probation, (probation usually requires drug treatment or counseling anyway) I think this guy is just seeking our votes without giving much. Better in my opinion to make punishment of <oz punishable by just a fine. Magistrate (misdemeanor) judges in NM are usually not law trained, often former cops appointed by the governor, and they DO often give jail time (up to the 15 days) for possession of what are clearly personal use quantities. Add to this the borderland overkill in federal grants, and we get seriously stupid and heavy local enforcement against drug users and sellers to end level users, especially in the southern part of the state. If this guy's a true friend, how about actually trying to decriminalize personal use quantities of marijuana at the very least.
