1. General

These terms and conditions set out the rules applicable to Facebook, Inc’s (“Facebook”) German language applications contest (the “Contest”). By submitting an entry for the Contest, participants agree to abide by (i) these rules, (ii) the developer terms of service (available at: http://developers.facebook.com/terms.php) along with all documents incorporated into such terms by reference, and (iii) any decision Facebook makes regarding the Contest.

2. Participation and Eligibility

The Contest is open to all participants over the age of 16 at the time of entry (the “Participants”). Employees, contractors and agents of Facebook, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members (parent, sibling, child or spouse of any of the foregoing) and/or those living in the same household of each are not eligible. No purchase by Participants is necessary to participate in the Contest. Participants aged 16 or 17 must ensure that they have their parents’ or guardian’s consent to entry into the Contest.


3. Application Requirements

To enter the Contest, Participants must create a German language application for use on the Facebook site at http://www.facebook.com/ (“Application”) and register their Application in accordance with clause 4 below. German language applications created prior to the date on which this Contest was announced are eligible for the Contest provided registration requirements at clause 4 below have been met. It is a condition of entry into the Contest that all inputs to and outputs from the Application and all associated documentation are in the German language.


4.Entries

Entries must be submitted using the Win a Prize application entry form on the Facebook site at: http://apps.facebook.com/winaprize/contests/174/entry/new. Participants warrant and represent that all information submitted or otherwise provided as part of the Contest is true and accurate, including, without limitation, any representation made regarding authorship of a particular Application and the Participant’s right to submit the Application to the Contest.


There is no limit on the number of entries that may be submitted by a Participant though each entry must be registered separately. Facebook will not acknowledge receipt of entries and only the winners of the Contest will be contacted.


5. Duration of the Contest

The Contest is valid for entries submitted from 00:00 PST on May 14, 2008 to 23:59 PST on August 31, 2008 (the latter being the “Closing Date”). Any entry submitted after the Closing Date will not be eligible for consideration in the Contest.


6. Selection of the winner

Facebook will select the winning Applications based on the average number of Facebook users actively using each Application in the German language over a one month period following the Closing Date (“Measurement Period”). The decision of Facebook is final and no correspondence will be entered into.


Facebook will award prizes to the Participants who submitted the winning Applications as set out in clause 7 below.


7. Prizes

Prizes will be awarded as follows:

o Main Prize: Highest average number of active users during the Measurement Period:
20,000 Euros

o Second highest average number of active users during the Measurement Period:
10,000 Euros

o Third highest average number of active users during the Measurement Period:
5,000 Euros

o Fourth highest average number of active users during the Measurement Period:
3,000 Euros

o Fifth highest average number of active users during the Measurement Period:
2,000 Euros


The prize winners will be announced on the Facebook German Application Contest page (available at: http://www.facebook.com/german-app-contest) of the Facebook site on or before October 7, 2008. No Participant will be entitled to win more than one prize.


8. Taxes

All taxes associated with the receipt or use of the prizes are the sole responsibility of each winner. Facebook reserves the right to withhold any taxes as required by applicable law. All prizes will be awarded (other than to the extent withheld for tax purposes as required by applicable law).


9.Discretion to Disqualify

Facebook reserves the right at any time to disqualify Applications from the Contest where, acting in good faith, it believes there are reasonable grounds to warrant disqualification, for example, if Facebook considers that the Application disrupts users’ experience of the Facebook site, the Application does not provide any real functionality for Facebook users, or the Application appears to be purposely designed or used to circumvent the spirit of the Contest.


Applications will be automatically disqualified from the Contest in the event that they breach Facebook’s developer terms of service (available at: http://developers.facebook.com/terms.php) or the terms of any documents incorporated into the developer terms of service by reference.


10. Data Protection and Publicity

By entering the Contest, the Participant acknowledges that Facebook will collect, process and use the personal data provided by the Participant in connection with and for the purpose of administering of the Contest. Facebook may use third party providers for processing purposes and Facebook will ensure that appropriate arrangements are in place with such third parties to ensure that the security of the Participant’s personal data is adequately safeguarded. Facebook will only use the Participant’s photograph and personal data provided by Participant for post-Contest publicity where the Participant separately consents to such processing and use.


11. Exclusion of liability

By entering the Contest, the Participant agrees that Facebook and its affiliates and agents, and the officers, employees, directors and representatives of these entities are not responsible for any liability, injury, losses or damages of any kind arising from or in connection with participation in the Contest or acceptance, possession, receipt, use of the prizes. Facebook assumes no responsibility for incomplete, misdirected, damaged or illegible entries nor for any delayed entries or those not received for whatever reason, including without limitation due to internet or e-mail server failure. Nothing in this clause 11 or otherwise in these rules shall exclude or in any way limit Facebook’s liability to the Participant for any liability to the extent the same may not be excluded or limited as a matter of applicable law.


12. Applicable law

This Contest and its rules are governed by laws of the State of Delaware. The Contest is subject to all applicable laws.


13. Promoter of the Contest

Na dann gibts sicher bald www.gesichtsbuch.com . Microsoft könnte ihre nächste Versionen auch "Fenster 7" und "Büro 14" für uns Deutschsprachigen benennen. :-)
