“野草莓運動”行動聲明 Statement Nov. 9

行動緣起

陳雲林先生訪台期間，發生多起侵害人民的表意自由（特別是言論自由）的事件。例：11月3日下午，圓山飯店牌樓下，揮舞雪山獅子旗的人被警察奪走旗幟；4日上午，警察沒收圓山飯店內市民陳育青的攝影機，並強制押回警局；4日晚間，位於中山北路的上揚唱片行播放〈台灣之歌〉，警方衝入店家關掉音樂，並強制拉下鐵門。絕大多數遭致警察暴力相向的民眾，根本不曾靠近陳雲林人身，有的市民甚至只是路過、停留或單純拍攝記錄，即遭受上述對待。一連串事件中，警察乃「奉命」行動，而非「執法」，因為當人民詢問警察執的是哪一條法，警察自己也不清楚。警察應「依法行政」，但在國賓來訪期間的部分事件中，警察的行動顯然取消了言論自由，號令警察的官員漠視憲法對基本人權的保障，規範公民行為與警察職權的法律彷彿都不存在。是什麼樣的政策使得警民暴力相向、彼此傷害，言論自由被暴力消音－－對此，我們無比義憤。

國賓離台後，一切看似重上軌道，但是國家機器漠視法律的情形必須被正視，我們認為國家的領導團隊必須就這段期間的警察違法濫權出面道歉，並承認行政濫權是錯誤；負責維安策略、實際指揮公權力的警政署長與國安局長必須下台，為其決策與指揮負起責任；同時，調查每一起國家暴力侵犯人民基本權益的事件並進行懲處，這樣人民的基本自由才能重獲保障。然而，6日之前，政府漠視激湧的批評聲浪，甚至為這段期間的警察執法行為背書，我們難以期待體制內的管道能讓行政首長承認錯誤，只好以非暴力的靜坐形式，發起11月6日行政院前的抗議，以非暴力、合理卻不合法的方式靜坐，突顯法律的問題。11月7日下午四點，警方將我們驅離，這是必須承受的後果，我們欣然接受。依據所有運動參與者早先的決議，我們來到自由廣場，決定不依集會遊行法申請集會，以對抗這一個必須被修改的法律；我們將在自由廣場持續靜坐，直到執政者對於我們的三點訴求做出回應。經各地靜坐同學串聯表決，我們決定了靜坐抗議運動的名字：「野草莓運動」。

三項訴求

野草莓運動的訴求有三：
(1)馬英九總統與劉兆玄院長公開道歉；
(2)警政署長王卓鈞、國安局長蔡朝明下台；
(3)修改集會遊行法。

以下分別說明。第一點與第二點是為了強調國家元首與行政首長犯下的錯誤，要求政府尊重憲法、依照憲法保障基本人權的意旨行法治。言論自由被傷害了，我們必須正視，這是我們的消極要求。言論自由為甚麼重要？試想，假使當年政府動員警力驅散凱達格蘭夜市、驅散紅衫軍，那麼台灣的公民就沒有機會聽取社會上不同的意見；正是因為他們沒有被驅散，不同的聲音才得以被聽見。人不是一出生就知道民主是什麼，民主仰賴公民獨立的、理性的判斷，而只有曝露在各種不同的意見中，才能學習如何判斷意見的優劣。言論自由是公民社會不可或缺的條件，是民主的保障。

正因自由如此可貴，憲法明文保障此項自由。位階較低的法律，應該輔助憲法，將之具體實現並定其界限。然而，威權時代、戒嚴時期遺留下來的集會遊行法，卻嚴重危害同屬憲法保障下的集會結社自由。事前許可制是對於人民透過集會遊行表達意見自由的不當箝制；它的禁制區寬免政府機關於民意的挑戰；它授予警察過大的裁量權，儘管人民可以事後提出救濟，然而在當下，該自由已經受到壓制，而壓制所帶來的傷害是無法彌補的。因此，野草莓運動對於自由權保障的積極要求，是修改集會遊行法。但是，我們必須強調，如果國家機關未能依法行政的現象沒有被嚴肅對待，如果人民受傷、權益受損的事件沒有被調查清楚，那麼，即使我們修法確保了我們集會遊行的自由與安全，行政權仍然可能無視於修訂的法律；只要有一時的藉口，公權力隨時可以摀住我們的嘴，不讓我們發聲——這不就是陳雲林先生訪台期間的狀況嗎？

所以，野草莓運動的三項訴求是環環相扣的。已經犯下的錯，我們要求總統與行政院長公開道歉，承認憲法保障的基本人權不可蔑視，承認警察行動應該於法有據，同時，警政署長王卓鈞、國安局長蔡朝明應該下台。如此才能使行政首長承認陳雲林訪台期間確實出現漠視憲法、行政濫權的狀況，才能讓公民相信政府不會重蹈覆轍，這樣我們要求的積極的言論自由，也就是修改集會遊行法，才不會在未來淪為泡影，而集會遊行法之修改，是為了重新確立行政權在例外狀態中無視的憲法，以及憲法保障的基本權益。人權不可以有例外。

我們不會輕易離去。而且，我們強調，如果只修改集會遊行法，行政首長卻沒有公開道歉、政府沒有調查相關事件並懲處失職者，那等於告訴公民，法治原則可以違背、憲法保障的基本權益可以漠視，那麼，即使我們修出一部充分保障集會遊行自由的法，也無法確保我們的言論自由。所以，野草莓運動不會接受方便的下台階，道歉之前，野草莓仍會繼續蔓生。

抗議警察暴力！捍衛自由人權！

從11月3日開始，中國海協會代表團來臺與政府簽署各項協定，同時在臺北各處，就陸續出現警方藉「維安」之名，對各類以和平方式表達不同意見者，進行粗暴的盤查、損毀、沒入、禁制、拉扯、驅離甚至拘捕。絕大多數遭致警察暴力相向的民眾，根本不曾靠近陳雲林人身，有的市民甚至只是路過、停留或單純拍攝記錄，即遭受上述對待。

透過媒體畫面傳送，我們驚覺事態嚴重—這已經不是維安有否過當的技術問題、更不只是政黨認同選擇的問題，而是暴力化的國家公權，對市民社會的嚴重挑釁和侵犯。所有彷彿戒嚴、罔顧自由人權與民主價值的管控鎮壓，連執政黨的國會議員都質問行政院長；卻只見身為最高責任主管的劉揆，仍在輕佻地詭辯和推責。實在令人既錯愕憤怒，又深感羞辱和不安。

我們不禁要問：難道要強化兩岸經貿交流，也必須透過降低臺灣的民主自由程度、以達成與中國同樣極權統治的水準嗎？

才不過短短幾天，臺灣人民好不容易匍匐建立的民主自由體制，在滿城的警力、威嚇的氛圍與強勢的防堵中，幾近崩解。我們政府，在如同警察國家的武裝保護裡，自我陶醉於「歷史性儀式」的想像、與酒酣耳熱的輪番大宴中。於此，憲法所保障人民的自由言論與行動權利，完全地被擱置、甚至忘卻。

因為多數的強勢作為根本違憲違法，無怪乎鏡頭前沒有一個警察能理直氣壯說出，他們根據何種「法律」，執行這般上級交待的勤務。警察原是保護人民的公僕，如今在這政府由上而下的嚴峻要求中，競相成了限制與懲罰人民表達意見的打手。我們無意歸咎個別只能服從上命的員警，相對的，我們嚴正要求下達此一惡令的政府高層，必須負起最大的政治責任。

我們只是一群憂心臺灣混亂現況與未來發展的大學教授、學生、文化工作者和市民，在沒有任何政黨與團體動員及奧援的前提下，十一月六日（四）上午十一點，將自發性地集結於行政院大門前，以「著黑衣、戴口罩」作為沈痛抗議的象徵，並牽手靜坐至訴求達成為止。我們的訴求是：

一、 馬英九總統和行政院長劉兆玄必須公開向國人道歉。

二、 警政署長王卓鈞、國安局長蔡朝明，應立刻下臺。

三、 立法院立即修改限縮人民權利的「集會遊行法」。

Protest police brutality! Defend freedom and human rights!

Starting on November 3, with the visit of representatives from China's Association for Relations Across the Taiwan Strait (ARATS) to sign various agreements with our government , police officers have engaged in numerous abusive acts against peaceful protesters from various dissenting groups, under the guise of "keeping the peace." These acts have included arbitrary searches and prohibitions, seizure and destruction of property, physical assault, dispersion, and even arrest and detention. The vast majority of the victims of this police brutality were nowhere near ARATS chairman Chen Yunlin, and were simply passing, standing, or photographing various areas when they were victimized.

Through reports in the media, we have come to realize the seriousness of the current situation. It is no longer a technical question of excessive law enforcement tactics, nor is it simply a partisan issue between supporters of various political parties. This is a proliferation of state sponsored violence that is provoking and attacking civil society. All these oppressive acts, which ignore human rights and democratic values are reminiscent of martial law. Even legislators from the ruling party have expressed concern over this issue to the Executive Yuan, only to see the chief authority - Premier Liu, dodge responsibility while providing only the flimsiest of excuses. We are stunned and outraged by this response, as well as ashamed and increasingly uneasy.

We must ask: Does increasing cross-Strait exchange require Taiwan to lower its standards of freedom and democracy, in order to achieve the same level of repressive authoritarian rule that China has?

In only a few short days, the liberal democracy that the people of Taiwan have fought so hard for has nearly collapsed amid massive police presence in the city, and the atmosphere of fear and repression that it brings. Behind its police state-like barricades, our government remains blinded by its delusions of a "meeting of historic proportions," and indulge itself in its receptions and banquets. Through this all, the peoples' constitutionally guaranteed rights to freedom of speech and movement have been cast aside, and even forgotten.

As many of their actions are unconstitutional, it is not surprising that not a single police officer before the cameras has been able to definitively state what law empowers them to carry out the orders issued to them by their superiors. Police officers are supposed to be civil servants charged with protecting the people. Yet under the outrageous requests issued from above, they have become thugs restricting and punishing the people for expressing their opinions. We have no intention of blaming individual police officers who can only obey orders issued by their superiors. Rather, we solemnly demand that the highest authorities in the government bear the largest share of political responsibility for these abuses.

We are simply a group of university professors, students, cultural workers, and citizens who are concerned about Taiwan's current state of disorder and future development. At 11AM on November 6, without any support or mobilization from any political party or civic group, we will assemble at the gate of the Executive Yuan in black clothes and face masks symbolizing our painful protest, and will join hands sitting in civil disobedience until our requests are met. Our requests include:

President Ma Ying-jeou and Premier Liu Chao-shiuan must publicly apologize to all citizens.

National Police Agency Director-General Wang Cho-chiun and National Security Bureau Director Tsai Chao-ming must step down.

The Legislative Yuan must revise the Parade and Assembly Law, which currently restricts the rights of the people.

このような無茶なやり方は、根本的に法律違反かつ憲法違反である。カメラの前に堂々となんの法律を基づき、勤務を執行するといえる警察がないことも、不可解ではない。警察は人民を保護すべきだったが、政府より下した峻酷なる命令によって、民衆自由を制限し罰する悪党に変貌したのだ。我々は警察一人一人を咎めるつもりはない。ただし、我々はこうした不正な命令を下した政府の責任者に着実に責任を取ることを厳正に要求する。

我々は台湾の混乱なる現状と今後の発展を心配する、ただの大学教師、学生そして市民である。何らかの政党団体の動員や応援も一切断るという前提において、十一月六日（木曜日）午前十一時、自発的に行政院（日本内閣府相当）前に集会していた。「黒服とマスク」をこの沈痛なる抗議の象徴にし、我々の要求が受け止められるまで、手を繋いで座り込みをする。

我々の要求は：

一、馬英九総統と行政院劉兆玄院長が謝罪すること。

Angefangen am 3. November, mit dem Besuch von Chen Yunlin, hat die Polizei zahlreiche Aktionen gegen Demonstranten durchgeführt, darunter die Beschlagnahmung und Zerstörung von Eigentum, physische Gewalt, und sogar Verhaftungen. 요 며칠 사이에 대만 사람들이 힘들게 해 왔던 민주자유체계는 경찰국가의 무서운 분위기와 강제적인 행위에서 붕괴하고 있다. 대만 정부는 경찰국가와 같은 무장보호에서 「역사적 의식」의 상상에 자기 도취하고 있으며 끝없이 연회를 하는 것과 같은 착각에 빠져 있다. 그렇기 때문에 헌법에서 국민의 자유언론과 행동권리는 완전히 내버려 두고 심지어 망각하고 있다.
다수 행위는 기본적으로 헌법에 위반하고 있으므로, 뉴스로 나온 화면에서 경찰들에게 어느 법에 의하여 이런 행위를 하느냐고 물어 봤을 때 상사의 지시라는 대답을 할 수 밖에 없었다. 경찰은 원래 국민들을 보호해야하는 국민의 심부름꾼이데 지금 정부의 불가사의한 지시로 국민에게 규제와 징벌을 하는 정부의 졸개가 되어버렸다. 우리는 지시를 복종하는 경찰에게 죄를 돌리는 것이 아니라 이런 지시를 하라고 하는 고위층 정부 관료에게 이 일에 대해 책임지라고 엄정하게 요구해야 한다.
우리는 대만의 이런 혼란스러운 현실과 앞으로 발전 방향을 걱정하고 있는 대학 교수、학생、문화 언론인과 국민들이다. 어느 정당이나 단체가 우리를 동원과 지원을 하지 않는 전제 아래, 우리는 11월6일 오전 11시(대만시간) 자발적으로 행정원 앞에서 엄중한 항의의 상징인 검은색 복장을 입고 마스크를 쓰고 평화 연좌 집회를 하기로 했다. 우리 요구를 달성할 때까지 계속할 것이다.
우리 주장은 아래와 같다.
1. 마잉주(馬英九)총통과 류자오쉬안(劉兆玄)행정원장은 국민에게 공식적으로 사과하라

Depuis la visite du 3 Novembre du représentant chinois de l’Association pour les relations entre les deux rives du Détroit de Taïwan (ARATS) afin de signer divers contrats avec le gouvernement taïwanais, les agents de police ont commis de nombreux actes abusifs envers des opposants pacifiques de différents groupes, sous le prétexte du « maintien de l’ordre ». Ces actes comprennent fouilles et interdictions arbitraires, confiscations et destructions de biens, attaques physiques, dispersion de rassemblements et même arrestations et détentions. La grande majorité des victimes de cette brutalité policière n’étaient même pas dans les environs du président de l’ARATS, Mr Chen Yu Lin, et s’étaient simplement trouvés être, passer ou photographier divers endroits quand ils ont été pris à parti.
D’après la couverture médiatique, nous nous sommes rendu compte de la gravité de la situation. Il ne s’agit plus d’une question technique de l’application de la loi, ou encore d’un différend entre les partisans de divers partis politiques. Ceci est la généralisation de la violence étatique, qui provoque et attaque la société civile. Tous ces actes d’oppression, qui ignorent les Droits de l’Homme et les valeurs démocratiques, rappellent l’époque de la loi martiale. A tel point que même des députés de la majorité ont exprimé leur inquiétude à ce sujet au Yuan exécutif (gouvernement), cependant que Mr Liu (premier ministre) a esquivé toutes responsabilités avec des excuses des plus minces. Nous sommes choqués et outrés de cette réponse, tout autant que consternés et humiliés.
Nous devons alors nous demander : est-ce que l’augmentation des échanges entre les rives du Détroit nécessitent que Taiwan doive rabaisser sa conception de la liberté et de la démocratie, jusqu'à atteindre le niveau du pouvoir répressif et autoritaire chinois ?
En quelques jours seulement, la démocratie libérale pour laquelle Taïwan a durement lutté, s’est pratiquement effondrée au travers de la présence policière massive en ville, et de l’atmosphère de peur et de répression qu’elle implique. Derrière ses barricades policières, le gouvernement reste aveuglé par l’illusion de cette « rencontre historique » et se fourvoie en réceptions et autres banquets. Pendant ce temps, les droits des citoyens concernant la liberté d’expression et la liberté de mouvement, pourtant garantis constitutionnellement, sont mis de côté et même oubliés.
Comme la plupart de leurs actions ne sont pas constitutionnelles, il n’est pas surprenant qu’il n’y ait pas eu un seul policier capable de définir clairement face à la caméra quelle loi les habilite à suivre les ordres de leurs supérieurs. Les agents de police sont supposés être chargés de la protection de la population. Mais à cause d’ordres venant de leur hiérarchie, ils se sont transformés en gangsters qui réprimandent et empêche le peuple d’exprimer son opinion. Nous n’avons pas l’intention de blâmer individuellement les policiers qui ne peuvent qu’obéir aux ordres de leurs supérieurs. En revanche, nous demandons solennellement aux hautes autorités du gouvernement d’assumer leur part de responsabilité pour ces abus.
Nous sommes un simple groupe de professeurs, étudiants, animateurs culturels et citoyens qui est concerné par l’état de désordre actuel de Taïwan et son développement futur.
Le 6 Novembre, à 11H, sans aucune aide ou mobilisation d’un quelconque parti politique ou groupe civique, nous nous réunirons devant la porte du Yuan exécutif (gouvernement) vêtus de noir et de masques afin de signifier notre désaccord profond, et nous nous tiendrons la main jusqu’à ce que nos revendications aboutissent. Nos revendications sont les suivantes :
1) Le président Ma Ying-Jeou et le premier ministre Liu Chao-Shiuan doivent s’excuser publiquement auprès de tous les citoyens.
2) Le directeur général de l’Agence Nationale de Police Wang Cho-Chiun et le directeur du Bureau National de la Sécurité doivent démissionner.
3) Le Yuan législatif (assemblée) doit revoir rapidement la loi sur les manifestations et rassemblements qui actuellement restreint les droits du peuple.
