Re: Bigstone Cree Nation
I am writing to you on a very important and exciting event that is about to take place within our First Nation.. .an event that has been many, many years in the making and which many of our Elders who have passed on, regretfully, will be unable to enjoy... a ratification vote on the settlement of our Land Entitlement and Agricultural Benefits Claims under Treaty 8. There will also he a vote on amendments to BCN’s Customary Election Regulations.The vote on these matters will take place between February 22 and March 5, 2010 at the polling stations identified on the attached page. In addition, off reserve Members will be given the opportunity to vote by mail in ballots which will be mailed out or delivered to you.I have been asked by some of our Members living off BCN Reserves what is in this settlement package for them. That is a very good question and one that I very much enjoy answering because we have attempted to take those Members’ interest into account as we put this settlement together.Firstly, all Members of BCN, adults and children alike, will receive a payment of $3,500.00 each out of the settlement funds. The childrens money will be deposited into a trust fund at a chartered bank where it will earn interest and be paid out with that interest to each of them when they reach the age of eighteen years of age. Given the size of our membership it was felt by the BCN negotiating team and Chief and Council that this was the most that could be given without depleting the capital of the settlement trusts which is there for future generations.Secondly, as part of the settlement the Nation Trust will be established which will, within three to five years have approximately $48,000,000 paid into it. Each year, “all” Members on and off Reserve alike, will he able to recommend how fifty percent of the income earned in that trust might be spent, and “all” Members will get to vote on which of those recommendations put forward by the Trustees will be approved. The other fifty percent of the income generated will he reinvested in the trust each year so that the trust will grow for the benefit of today’s Members (who will benefit from the anticipated ever increasing income from the ever increasing principal amount) and future generations to come (who will benefit by the increasing capital amount).Thirdly, for the lrst time in any First Nation settlement that has ever been made with the governments, we will establish an Off Reserve Trust that will receive eight million dollars of the settlement funds and which will he dedicated to funding services and programs for off reserve Members exclusively. An off reserve Member will sit along with two Members of Council as one of the three ‘Trustees of the trust. Again, fifty percent of the income generated by this trust will be available to fund off reserve initiatives proposed and voted on by off reserve Members exclusively.Finally, there are the overall elements of the settlement to consider which include increasing the Reserve by at least seventy seven thousand acres whose resources and additional land base will serve to enhance BCN’s overall economic wellbeing, and in doing so (the wellbeing of all of its Members including the off reserve Members.As a final note, I would like to advise you that I have recommended to Council that we establish an Off Reserve Committee which will meet on a regular basis with a view to providing recommendations and advice to Council with respect to ongoing matters affecting the Nation.1 do hope that you ‘will see the benefits that will flow not only to yourselves, and your children but also to the many generations of BCN Members to come.
