Last year, I went to Extreme Fitness to sign up for a gym membership.
The salesperson told us that they can freeze the account for as long as we need. Being a co-op student, and not knowing where my next work term would be, I needed to make sure that they can hold it for one whole year (4 months school + 4 months work not in TO + 4 months school), which he ensured me that this was possible with the catch being that they can only freeze it for 4 months at a time, so that we have to call back or email to renew the freeze every 4 months.
Additionally, one of his selling points was that even OTHER clubs do not offer this freezing option free of charge. That being said, I signed up with a friend for a corporate plan and prepaid for one year.
BUT …
I received a letter last week that claimed I owe them 2 months worth of payments, but I should actually still have several prepaid months available. When I told the Director, Member Services that I should still have prepaid, she told me very rudely that they only freeze accounts for a maximum of 4 months / year.
So I told her what the salesperson told me, and her response was: “I appreciate that, but we only go by what you have signed (in the contract)”
[There wasn’t even a slight attempt at some sort of apology for the salesperson’s mistake, or any attempt to correct his mistakes – which leads me to think that they do it on purpose]
and so, she's making me pay for 3 months right now before letting me close the account
AND not giving me any of the months that I paid for already!
After digging up the contract again, and reading the size 8 font, there’s one vital point hidden in there: “THIS CONTRACT OVERRIDES ANY OTHER AGREEMENT” (including verbal agreements… so it overrides everything the salesperson said)
p.s. the only reason that they have not been able to automatically deduct this money is because my credit card expired...
p.p.s. it says that there is a fee of $20/month frozen account and a min of 2 months - max 6 months per year (which contradicts what both extreme fitness personnel said)
