Living here in California, and especially San Francisco, sometimes you take for granted that you have equal protection under the law. Then you get the reminder like this that all of us are not equally protected under the law. I hope that the Senate will make the just decision and move quickley on this legislation. ENDA needs to pass, and soon!

Simplify discrimination until it disappears. Senate should recognize that our judicial system can be held to the letter of the law; one phrase; one idea to prevent any type depravety and hold honor of duty to the fullest meaning for ALL PEOPLE.

Based on this issue and the issue of gay marriage, I wonder if there's a precedent for a massive class action suit against the Federal and State governments for discrimination? GLBT Americans are certainly treated as 'less than' straight Americans and have less rights. A violation of the Constitution?

You'ld never win a law suit. I don't even think the constitution grants individuals the right to sue the govt when the thing you're suing about is a public policy. For example, an abortion opponent has no legal standing to sue the govt because his tax dollars go to fund abortions for the poor. A quaker can't sue the govt because his tax dollars ... See Moreare funding two wars he doesn't approve of. If the Supremes gave every citizen the right to sue the govt over policies he disagrees with, the govt would go out of business faster than it is. What you would need to do is have a couple who is trying to get married argue that DOMA is unconstitutional. They wouldn't get anywhere. I think a couple from CA tried that last year when Prop eight was passed in CA. That's when Obama's justice dept wrote a scathing brief defending DOMA by comparing gay marriage to bestiality and pedophilia. The dept also argued that gay marriage was a burden on tax payers who don't want it. I may be wrong but they did make some screwy public policy argument against marriage equality on the grounds that doing away with DOMA was a fiscal burden. Actually, I think they argued that if you did away with DOMA and you started giving federal bennies like Soc. Sec. to same sex couples it would be a fiscal burden and not fair to folks who oppose it. Anyway, if Obama compared us to pedophiles, we're never going to get a Court dominated by conservative Republicans to allow us to sue the govt. Dream on.

If folks really feel that strongly about opposing states and the feds, they should think about becoming tax protesters. That's a form of civil disobedience. But just as folks like Thoreau and MLK, Jr., were willing to go to jail for their civil disobedience, we'ld need to be willing to suffer the consequences for actions, too. But you can't sue... See More a state when it's const says same sex marriage is illegal. And the feds don't recognize same sex marriage because of DOMA. So you can't sue them because they say same sex marriage is illegal. And if we resort to violence or engage in some other idiotic act, we just might wind up with a President Palin getting a US Const'l Amendment passed making gay marriage illegal in all fifty states. Then we would really be in the proverbial soup.

I just learned about this issue yesterday when I received an e-mail from HRC; I am still in a state of shock. I had no idea that people could be fired because of their sexual orientation. I have contacted my congress person and will spread the word to as many people as possible to do the same. Thank you HRC for bringing this to my attention.

Funny thing is, alot of people do not realize that LGBT folks face this kind of discrimination. I am glad to see that our rights are finally being taken seriously....at least partially.
