Retailers, chain stores in N.Y. must provide bag bins
Dec. 15 -- Large retailers and chain stores in New York must provide bins to collect plastic bags, effective Jan. 1, under state legislation Gov. David A. Paterson has signed.
Retail establishments larger than 10,000 square feet and those with more than five stores, each having more than 5,000 square feet of retail space, must collect the bags and recycle them. They must keep records for three years on how many bags they´ve collected and recycled.
The state law pre-empts local governments from adopting their own plastic bag laws, including bans and collection programs. But New York City will be allowed to retain its law under an agreement with the state legislation, which will pass additional legislation to amend the bill Paterson signed.
