Chief Brown Terminates One and Disciplines Another

Following an investigation by the Internal Affairs Division and disciplinary hearings held this morning, Dallas Police Chief David O. Brown terminated Police Officer Kelly Schumpert, #9982 and issued a 30 day suspension to Senior Corporal Stanley McDaniel, #5676.

 

On February 8, 2012, Officer Kelly Schumpert, #9982, was arrested by the Forney Police Department for investigation of DWI after being involved in an accident.  The Internal Affairs investigation concluded that Officer Schumpert engaged in conduct which adversely affected the morale or efficiency of the Department or which had a tendency to adversely affect, lower or destroy public respect and confidence in the Department or officer. 

 

Officer Schumpert was terminated.  Officer Schumpert was assigned to the Southeast Division and had been on the Department since September 2009.

 

On October 22, 2010, Senior Corporal Stanley McDaniel, #5676 and his trainee were marked out at a location where an arrest was made and a subsequent arrest report completed.  The Internal Affairs investigation concluded that Senior Corporal McDaniel caused to be entered inaccurate, false, or improper information on a report of the Department.

 

The Internal Affairs investigation also concluded that Senior Corporal McDaniel failed to follow the policies and procedures of the Department when on two separate occasions he failed to immediately clear upon completion of a call. 

 

On December 13, 2010, during an interview with the Public Integrity Unit, Senior Corporal McDaniel was found to be untruthful.  The Internal Affairs Division investigation sustained the allegation for being untruthful.

 

Senior Corporal McDaniel received a 30 day suspension for these violations.  His past disciplinary history played a significant role in determining today’s discipline.  However, one area of his disciplinary history that could not be factored in was a termination Senior Corporal McDaniel received in May 2008 that was upheld by the City Manager, but was eventually overturned by the Administrative Law Judge during an appeal hearing in January 2009.

 

Senior Corporal McDaniel is currently assigned to the Auto Pound, but was assigned to the Northeast Division during the time of his most recent incident.  He has been on the Department since June 1987.

 

Under civil service rules, Officer Schumpert and Senior Corporal McDaniel have a right to appeal their discipline.
