Brent Barton Oregon's most significant contribution to American jurisprudence has been both a source of controversy and pride. In the 1970s and '80s, Oregon pioneered the concept that states can/should interpret their constitutions in ways that provide broader liberties than the federal constitution. The most notorious example is... Article I, Section 8 of the Oregon Constitution, which provides greater free speech protections than the First Amendment of the U.S. Constitution. For a few highlights of Oregon's role in this revolution, check out the attached article at pages 17, 39-40 as well as footnotes 5, 219, 222.

Brent Barton I bet you've never heard of the Tonnage Clause of the U.S. Constitution ("“No State, shall, without the consent of Congress, lay any Duty of Tonnage”). I never had either before Polar Tankers, Inc. v. City of Valdez, 182 P. 3d 614 (2009).

    • Brent Barton Apparently, the Tonnage Clause was important in the first decades of the Republic, but Polar Tankers was the first Supreme Court case that hinged on this clause since 1935.

      • Marty Beaudet That's because the Administration watered down the stimulus to please the Blue Dogs and the Republicans. Gov't spending has always been the key to job creation. Think New Deal. And unemployment yields the greatest return per dollar spent, because it goes to people who need to put all right back into the economy, creating jobs! Saving banks and Wall Street investors only puts the money in the pockets of those who horde it.

      • Tyler Scandalios A relatively more rosy explanation would be that this is due to the fact that productivity per worker in the US has increased dramatically during the recession and is still improving. This doesn't explain it all, but helps to shed some light on the situtation.

        Does raise an interesting question, though, of whether there is a way to manage risk somewhere in between the individual consumer and the individual manufacturer in order to promote faster pathways for critical innovation, as opposed to mer...e consumerism. Take, for example, medical treatments that attempt to cure terminal diseases, like Duchenne Muscular Dystrophy.

      • Mark Fritch In a perfect capitalistic system, there would be no problems. People would simply figure out that Thalidomide wasn't good for them and they would stop taking it. Doesn't that make perfect sense? Come on folks, we're all too uptight. If GMO's aren't good for us or the planet, we'll find it out soon enough. Yes, we're just too paranoid that a large corporation would ever do anything that would hurt any of us. Sorry, I have to go. A guy is calling me back about buying my three headed calf.

          There's affirmation for this POV looking at gender communication in both the private and public arenas too. Seems like Deborah Tannen (You Just Don't Understand) made a lot of observations that would dovetail nicely with this study.

          Also jus...t finished a book re confirmation bias and self justification(Mistakes were Made but not by me--Carol Tarvis and Elliot Aronson) that comes at this from a slightly different angle.
