Against this backdrop, the Environmental Law Instit...ute and the Woodrow Wilson International Center for Scholars have completed a comprehensive study of federal subsidies to fossil fuel and renewable energy sources. Our data reveal surprising facts about where public funds are going and how our current energy policy may actually undermine the transition to a low-carbon economy.

As part of its 40th Anniversary celebration, ELI is sponsoring a symposium on challenges for the new team at EPA. This daylong meeting, to be held at the Carnegie Institute for International Peace in Washington on October 6, will convene nationally recognized experts to discuss key issues facing the agency.

Keynoting th...e Symposium will be Judge David S. Tatel of the U.S. Court of Appeals for the District of Columbia Circuit. He will speak on the Administrative Process and the Rule of Environmental Law.

Under the heading of Old Business, leading environmental lawyers will consider EPA’s next steps on air pollution standards for stationary sources, notably utilities. The challenge of regulating risks from nanomaterials — tiny particles presenting great opportunities in manufacturing, energy production, and pollution control among other applications — qualifies as New Business, as EPA wrestles with how its old laws can effectively address the potential health and environmental impacts of these new materials. A panel of lawyers and scientists will discuss what needs to be done.

The afternoon program, Rethinking Risk Assessment, will examine important problems and issues in the use of scientific evidence in environmental decision making. Noted scientists and lawyers will consider how to deal with issues of ensuring impartiality to build confidence in agency actions. A second panel will examine the implications of new methods of detecting chemical impacts at the cellular level and the prospects for developing toxicity test methods that can reduce reliance on animal testing and costs and deliver results that can form a solid basis for regulatory decisions.

Dr. Paul Anastas, the nominee to serve as Assistant Administrator for Research and Development, has been invited to be the luncheon speaker.

John Kostyack (National Wildlife Federation) and John Echeverria (Vermont Law School) will discuss the Endangered Species Act.

John Kostyack is Executive Director of Wildlife Conservation and Global Warming for the National Wildlife Federation, where he leads a nationwide campai...gn to conserve wildlife and ecosystems threatened by climate change. He is currently focused on helping enact strong natural resources protection provisions in federal global warming legislation.

John frequently writes and lectures on meeting the challenges of conserving U.S. wildlife. With Professor Dan Rohlf, he recently published “Conserving Endangered Species in an Era of Global Warming” (38 Env. Law Rptr. 10203).

John has been a leader in Endangered Species Act policy and litigation, winning victories in cases to protect habitat for the ivory-billed woodpecker, Key deer, Florida panther, gray wolf, and Swainson’s hawk. He also represented a diverse coalition in an amicus brief to the U.S. Supreme Court in the Court’s first-ever global warming case, Massachusetts v EPA.

John Echeverria has been the executive director of the Georgetown Environmental Law and Policy Institute at Georgetown University Law Center since 1997 and played a pivotal role in the Supreme Court’s adoption of a reasoned approach to takings jurisprudence. Prior to joining Georgetown, he served as general counsel at the National Audubon Society, as general counsel and conservation director at American Rivers, Inc., and as an associate at Hughes, Hubbard & Reed. He was a law clerk to the Honorable Gerhard A. Gesell of the U.S. District Court for the District of Columbia. In 2007 Professor Echeverria was awarded the Jefferson Fordham Advocacy Award from the American Bar Association. He has produced several books and numerous articles on the private property rights issue, land use management, and natural resource management.

Allison D. Foley and David L. Feinberg(Venable LLP) will provide an introduction to RCRA and CERCLA and their many applications.

Ms. Foley's practice focuses on compliance counseling under the nation's environmental statutes, including the Resource Conservation and Recovery Act... (RCRA), the Toxic Substances Control Act (TSCA), and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Ms. Foley also counsels public and private entities on natural resource and environmental compliance issues related to infrastructure and land development projects.

Mr. Feinberg focuses his practice on criminal and civil environmental litigation. Prior to joining Venable, Mr. Feinberg served as law clerk to the Honorable Benson Everett Legg, Chief Judge of the District of Maryland.
