Kevin M Sullivan I don't know what to do. My childs due date was october 24th but i haven't heard anything from the mother in over 2 months. She changed her number and won't contact me. We are both in the military. How do i find out if the child is born yet?

I would recommend contacting a family law attorney and provide your child's mother's supervisor or division when and if you get to a point of enforcing custody issues. You do have rights, but you will have to take the initiative to enforce them if she does not allow you voluntarily. Seems as though if you are both in the military that she couldn't be too hard to locate.

How about a BBQ? Nothing gets dads moving like a firing up a pit and feeding people a big fat BBQ sandwich. $10 bucks a head or around there. Maybe send out a message to all the members asking for volunteers one of those Trailer Pit usage and possibly get someone to donate the meat.

Anyway, I'd would like to get something like that rolling here in Houston.

I can't speak for FFER as I don't know their official affiliations with therapists. I do, however, know that PAS is a huge problem.

I know that there are some online parenting classes that discuss PAS. Unavoidably some ex spouses are going to exercise PAS or else it wouldn't be the problem is it today. From what I have seen the best way to combat PAS is to remain the neutral parent in the middle of it by refraining from doing the same things the ex is. Actions speak for themselves, but those actions MUST BE DOCUMENTED or witnesses to have the profound impact desired. (CustodyXchange.com is a great tool for doing just that) Having said that, filing very specific injunctions will get something on record, but even then the judge will have to be willing to enforce it by way of contempt. From what I've seen this is something judges are hesitant to do because it's viewed as an "act against women" and the political fallout is at risk. Not all judges though. ... Read More

Dawn MickPete Does anyone know if there is an organization like this in western NY, Rochester or Buffalo area? Need help for my fiance. I don't think it's fair that laws all seem to be for the women. His X makes double what he makes yet he still has to pay $500 p/month plus pay for childs health ins and so on. Why should a man who wants to be in his childs life be punished?

Until the playing field is even this child support system is the way it is. I make it a point to just suck it up and stay away from complaining about it, but instead combat it by never missing an opportunity of custody and by being the best father I can be. It seems or appears that once the courts hear a complaint about how unjust the child support system is then that party is the subjected to questioning motivation on any other custody modification issues. Sort of like saying, "You only want to modify custody because you're sick of paying child support.". That's a common response and one that tilts the scale in the opposite. I just pay and make sure that every opportunity presented to make my child's life better is seized. I keep the complaints about child support to myself until the day comes that organizations such as FFER help us overcome or at least progress towards fairness.

you can get a "rule 11 agreement" - that's what we did, just to get something down on paper. but, I would get a lawyer either way. my understanding a "rule 11 agreement" is were you both agree on paper and have it signed by a "notary". you then can take that to a judge later after you get the final papers drawn up.

It sounds to me that she figured out that she may have to pay child support if you were to file papers while you had physical custody. This may or may not be true, but the mere threat of it must have spooked her into drastic measures. So she resorts to taking the child and holding the child as "ransom" so to speak. So now she is demanding that something be put in writing releasing her from that child support obligation just to be safe.

It's really sad, but it's a common situation that some ex-spouses try once they realize their actions may be called into question in family court. Take the kid and demand release from any responsibility that the court could impose. ... Read More

She figured out while you had the child that YOU had the same power as she does when it comes to filing papers with the court. I would venture to say that she probably had someone explain this to her and she panicked at the thought of having to pay you child support while you are being the primary caregiver.

Seems to me that if she's willing to give up her option at having you pay child support then the motivation here isn't so much to release you as it is to release herself from that possibility. Always consult your options with a family law attorney, but it sounds like it's a win win for you. I would venture to say that once she gets released from the threat of child support you will have your child and she can breath easy. If that situation works for a long period of time I would make sure you keep good documentation of that fact and consider a change of custody at a later date if she begins to neglect her visits and support of your son.

Don't be passive aggressive in this situation. If you have an agreement, make sure you exercise your visitations to the fullest even if she denies you. Deny is more than her calling and telling you she's not going to allow you to see him. Actually go and knock on the door at the agreed visitation location at the proper time and when or if denied document it in your journal.

James How do I go about getting my custody agreement change? When I first got divorced my son was 3 yrs old. and the mother and him lived in Dallas, while I was in Austin... Now he is 12 and I have since purchase a home across from his school. While currently I have the std agreement (every other wknd and every thursday). I would like to either split custody or have full custody.

You must bring the case in front of a Judge. It is always best if both parties agree to a visitation schedule but if you do not then it will be up to the court system. You must prepare for your case before you file just to make sure your case is strong. I would suggest you come into the office and have one of our volunteer attorneys hear your case. Good Luck!

FFER attorneys are a great resource for helping take those next steps. Family law attorneys should be able to file the proper papers for you in the court of jurisdiction, which is typically wherever the child resides for the last 6 months.
