יום ה', 17.9.09: קואליציה של ארגוני זכויות אדם, בראשות "רופאים לזכויות אדם – ישראל", "המוקד להגנת הפרט" ו"גישה – מרכז לשמירה על הזכות לנוע" שלחו היום פנייה למתאם פעולות הממשלה בשטחים, בתגובה למכתב מראש מת"ק עזה אשר הודיע להם על הפסקה מיידית של מתן מענה לפניותיהם בעניין פלסטינים המתגוררים ברצועת עזה. ראש המת"ק הודיע לארגונים כי מעתה והלאה יפסיקו גורמי הצבא למסור תשובות ועדכונים בעניין לקוחותיהם ועל הארגונים לפנות לגורם זר, חוץ ישראלי - הוועדה האזרחית הפלסטינית, בבקשה שזו תפנה לצבא.
בארגונים הביעו דאגה, כי הסירוב פוגע קשות בעבודתם של ארגוני זכויות אדם בישראל – הפעם על חשבון צרכים הומניטאריים דחופים של תושבי עזה.
ארגוני זכויות האדם, אשר מסייעים לאלפי פלסטינים המבקשים לצאת ולהיכנס את רצועת עזה לצרכים שונים, משמשים במקרים רבים כערוץ הייצוג היחיד העומד לרשות התושבים. היות שלתושב פלסטיני ברצועת עזה אין כל אפשרות לפנות לרשויות הישראליות באופן ישיר, והיות שמת"ק עזה הינו הגוף היחיד המוסמך להיענות לבקשתו, הרי שהדרך היחידה העומדת בפניו של אותו תושב במטרה לקבל תשובה או לזרז הטיפול בפנייתו הינה באמצעות ארגוני זכויות האדם: "סירובכם להשיב לפניות של ארגוני זכויות אדם ועורכי דין ישראלים, מהווה פגיעה הומניטארית קשה בתושבים הפלסטינים המתגוררים ברצועת עזה ובזכותם לייצוג, תושבים פלסטינים אשר חובתכם הראשונה במעלה הנה לדאוג לשלומם, לרווחתם ולצרכיהם ההומניטאריים", כותבים הארגונים.
הארגונים מדגישים עוד כי במקרים רבים רק פעילותם שלהם הובילה, להצלת נפשות ולפתרון בעיות וכי לחסימת פעילותם עשויות להיות השלכות קשות ביותר. כך במקרה של מעתצם ביאללה אבו מצטפא, פעוט בן תשעה חודשים הסובל מבעיות קרדיולוגיות קשות מלידה: ארבעה חורים בלב כאשר הלב ממוקם בצד הימני של החזה. הפעוט מטופל באופן קבוע בביה"ח אלנאצר בעזה אולם עקב החמרה במצבו הפנו אותו רופאיו לטיפול בביה"ח שיבא - תל השומר אליו זומן ביום 13.9.09. ביום 28.8.09 הגישה משפחתו בקשה למת"ק עזה, באמצעות הועדה האזרחית הפלסטינית, לתיאום יציאתו מעזה אולם עד ליום הזימון לא הועברה תשובת המת"ק לבקשה, ועל כן נמנעה יציאתו לקבלת הטיפול הרפואי. נוכח מדיניות הצבא שלא לטפל בפניות רופאים לזכויות אדם, אין אפשרות לברר מהי סיבת העיכוב כמו גם לזרז את הטיפול בבקשה הדחופה. זו רק דוגמא אחת מיני רבות.
לוועדה האזרחית הפלסטינית אין שום סמכות להנפיק היתרים או לאפשר מעבר, משום שהצבא הוא זה ששולט במעבר ארז.
הארגונים הביעו תמיהה על הסירוב גם לאור אישורו של מתאם פעולות הממשלה בשטחים כי חלק מתפקידו של מת"ק עזה הינו מתן מענה לפניות של ארגוני זכויות אדם ישראלים. לאחרונה אף יצר קשר ראש המת"ק, אל"מ משה לוי, עם אחד הארגונים כדי להציע פגישה על מנת לשפר את עבודתם מולו והצהיר כי גורמי המת"ק קיימים "למען הנישה ההומניטארית", קרי עבור התושבים הפלסטינים המתגוררים ברצועת עזה אשר נתונים לסגר מעל שנתיים. כעת, כעבור חודשיים, שיגר אל"מ לוי את המכתב בו הודיע על ניתוק קשרים מיידי עם ארגוני זכויות האדם.
הארגונים החתומים על המכתב: גישה, המוקד להגנת הפרט, רופאים לזכויות אדם – ישראל, האגודה לזכויות האזרח בישראל, הועד הציבורי נגד עינויים בישראל, יש דין, עדאלה, רבנים למען זכויות האדם.

עם פרסום דו"ח ועדת גולדסטון מודיעים ארגוני זכויות האדם בישראל כי הם לומדים את ממצאי הדו"ח ומסקנותיו, וקוראים לממשלת ישראל להתייחס לתוכן הדו..."ח בכובד ראש ולא לשלול את ממצאיו והלגיטימיות שלו מלכתחילה.
כבר עתה ברור כי ממצאי הדו"ח, שנכתב לאחר איסוף מידע וגביית עדויות מנפגעים פלסטיניים וישראליים, מצטרפים לשורה ארוכה של דיווחים המצביעים על כך שפעולות ישראל במהלך הלחימה ברצועת עזה, כמו גם של חמאס, הפרו את דיני הלחימה ודיני זכויות האדם. ארגוני זכויות האדם בישראל סבורים כי על מדינת ישראל לקיים חקירה עצמאית ובלתי תלויה לבירור חשדות אלו ולשתף פעולה עם מנגנון ניטור בינלאומי שיבטיח את עצמאותה של החקירה ואת יישום מסקנותיה. הארגונים פנו ליועץ המשפטי לממשלה בדרישה להקים גוף עצמאי שיחקור את פעולות הצבא במהלך "עופרת יצוקה", אולם דרישה זו נדחתה על ידו.
הארגונים מצפים מישראל כי תגיב בצורה עניינית לממצאי הדו"ח ושתשנה את מדיניותה להטיל דופי בכל מי שלא מיישר קו עם הגרסה הממסדית.

Human Rights groups in Israel provide initial response to Goldstone Report:
Israel Must Investigate 'Operation Cast Lead'
With the publication of the Goldstone Committee report today, human rights organizations in Israel are studying the report and its conclusions, and they call upon the Israeli Government to take the report seriously and to refrain from automatically rejecting its findings or denying its legitimacy.
Already it is clear that the findings of the report - written after gathering extensive information and testimonies from Israeli and Palestinian victims - will join a long series of reports indicating that Israel's actions during the fighting in Gaza, as well as the actions of Hamas, violated the laws of combat and human rights law.
Human rights organizations in Israel believe that the State of Israel must conduct an independent and impartial investigation into these suspicions and to cooperate with an international monitoring mechanism that would guarantee both the independence of that investigation and the implementation of its conclusions. The organizations have written to Israel's Attorney General to demand that he establish such an independent body to investigate the military's activities during “Cast Lead”, but he rejected their request.
The groups expect the Government of Israel to respond to the substance of the report's findings and to desist from its current policy of casting doubt upon the credibility of anyone who does not adhere to the establishment's narrative.
