Bennett Law Office, PC/Tamera H. Bennett ASCAP updated their annual list of the most popular ASCAP writer/publisher controlled holiday songs of the last 10 years. I guess I am getting old when I was surprised that Josh Groban's version of "I'll Be Home For Christmas" had more airplay than The Eagles' version. I really thought "Mary Did You Know" would make... the list. What a wonderful song written by Buddy Greene and Mark Lowry that according to AllMusic has been recorded and released on 395 separate projects in the last 10 years.

Hard economic times are part of the problem here. Companies that advertise have less to spend, so advertising revenues to broadcasters are down. Stations pay less for programming so income to the studios is down. Therefore, production budgets are also reduced, especially in discretionary areas like music. While the top artists will always get their price, I've seen a decrease in the number of songs used, in license fees being paid to lesser known artists for masters and publishing and to composers of underscore. With the increased quality of production library music, using hit songs by known artists is no longer as necessary as it used to be.

I agree that the anti-piracy education has been useless to date. The real solution, in my opinion, is to make is so easy to get music legally that there is little incentive or need to steal it. There will always be some that will break the law (just check out the guy speeding by you on the freeway), but most will do the right thing if given a ... See Morereasonable opportunity. Where the record industry has failed up until recently is providing that opportunity. Is a $0.99 iTunes download or Rhapsody subscription fee the way? Maybe, maybe not, but at least it's a start. And there are other methods that are being developed that, although they have a cost involved, feel free to the consumer, just like adding HBO to your cable bill. Is it free? No. Do most people agonize ever the cost? Again, no, they just pay it with all their other cable/phone/internet services on the same bill.

A question was asked on my blog regarding the relationship between Porsche and Adidas: It is my understanding that Adidas and Porsche have a license agreement in place where Adidas supplies the clothing for the Porsche race team. I agree that not everyone is looking online to purchase music, but I disagree with the recommendations regard...ing a new physical format. There will always be new formats, but I don't see the industry moving to a new physical hardware format to replace the CD anytime soon.

Barrel and Country artist Alan Jackson have teamed up to combat the
decline in record sales. Cracker Barrel just released an exclusive
Jackson CD and developed a full line of Jackson branded merchandise.
Both are sold in stores and online.

I am also excited that Cracker Barrel is reaching out to new artists with th...eir custom CD's. A deal was just inked with "The Zac Brown Band" for a CD and merch.

The records are not available for digital download from Cracker Barrel. Is that in the works? We will have to wait and see.

The Nashville Post reported, "Since 2003, Cracker Barrel has built its record label into a $50 million business that delivers music – some of it previously unreleased – from family-friendly artists that resonate with its core dining audience."
