This training will cover: Nuts and Bolts -overview, governing laws and rules, Chapter 7 versus 13, motions, obje...ctions, adversary proceedings and appeals. Initial Consultation With Client -obtaining information, completing bankruptcy forms, non-bankruptcy alternatives, pre-bankruptcy planning. Means Test: When and How to use it. Exemptions -state versus federal exemptions. Automatic Stay -when it arises, what it is, what creditors may or may not do. Meeting of Creditors -when it occurs, who is present, and what happens. Dismissal for Abuse: -considerations and consequences. Reaffirming Debt and Lien Avoidance - considerations and consequences. Discharge and Dischargeability:—what is it and what debts apply. Electronic Filing - how to take advantage of the new and innovative techniques. Federal Court Admission - how and where to apply.

10.27.09 – Wall Street Journal – proponents and critics of the movement to provide a “Civil Gideon” in the U.S. - a right to counsel for the poor in non-criminal matters that could gravely affect their health, economic security, and/or family integrity - are closely watching the implementation of a California pilot pro...gram that will guarantee access to counsel in some civil cases.
