Valparaiso University School of Law students will present arguments concerning First Amendment protection of attorney advertising to a panel of three state and federal judges during an annual test of their legal skills.
The students will be participating in the final round of Valparaiso University School of Law’s 21st a...nnual Luther M. Swygert Memorial Moot Court Competition to be held at 4:00 p.m., October 28, 2009 at the Valparaiso University Center for the Arts.
Hearing the arguments of law students who have made the final round are Justice Michael S. Kanne of the United States Court of Appeals, 7th Circuit, Justice Frank J. Sullivan, Jr. of the Indiana Supreme Court, and Justice David H. Sawyer of the Michigan Court of Appeals.
The annual competition is sponsored by the Swygert Family endowment to showcase current First Amendment issues. This year’s case will address whether attorney speech should be considered political or commercial in the framework of the Central Hudson analysis, and whether Georgia Rules of Professional Conduct 7.1(a) and 7.3(b) regarding attorney advertising and misleading speech are constitutional.
During the Swygert Competition, members of Valparaiso’s Moot Court Society begin by preparing briefs for their assigned party. That is followed by four preliminary rounds of judging held prior to the final round, in which distinguished jurists serving courts throughout the country read the four finalists’ briefs and hear their arguments. Prizes in the competition are awarded for “Best Oralist of the Preliminary Rounds”, “Best Brief”, “Best Oralist” and “Best Team”.
The late Luther M. Swygert served as assistant U.S. attorney for the Northern District of Indiana, chief district judge for the Northern District of Indiana and as chief judge for the U.S. Court of Appeals for the Seventh Circuit. Judge Swygert was awarded an honorary doctor of laws degree from Valpo’s School of Law in 1963. He also served as a jurist-in-residence and taught at the School of Law.

The Scholars and Advocates in Residence: Shaping the Public Dialogue series continues with Graeme Mitchell on Wednesday, February 18th. Mr. Mitchell's lecture " The Curious Case of Omar Khadr: Guantanamo's Canadian Detainee" will begin at 4:00 p.m. in the Benson Classroom.
Mitchell earned his Bachelor of Laws degre...e from Osgoode Hall Law School, York University in 1980 and his Master of Laws degree from the University of Chicago Law School in 1989. He is a member of the Saskatchewan and Manitoba bars. He has directed the Constitutional Law Branch of the Saskatchewan Ministry of Justice since 1992 and has represented the Attorney General for Saskatchewan in 38 constitutional cases before the Supreme Court of Canada, and served as an advisor to the Premier of Saskatchewan during the 1992 Constitutional Reform Process.

The event, co-hosted by Opportunity Enterprises (OE) and the Valparaiso Law Republicans, will begin at 6:30 p.m. in the Ulbricht Room at Valparaiso University School o...f Law; members of the community are welcome.

The discussion will be facilitated by Kim Opsahl, Vice President/External Affairs at Indiana Association of Rehabilitation Facilities, Inc. (INARF). INARF is a statewide membership organization that provides leadership and support to its constituency in the development of resources and promotion of quality services to effectively serve the comprehensive needs of people with disabilities in Indiana.
The Family and Friends Together meetings are part of an Opportunity Enterprises initiative, Family and Consumer Supports. The objective of this program is to better serve families with special needs children and siblings by sharing resources, information and volunteer opportunities. The J. Reuben Clark Society, the Student Bar Association, and Valparaiso University School of Law will be hosting Judge Thomas Griffith of the D.C. Circuit Court of Appeals on Monday, October 13th in the Benson Classroom. Judge Griffith will be speaking on the "Curious Role of the D.C. Circuit" and his talk will be be...gin at 4:00 P.M. lasting about an hour with question time to follow.
There will also be a reception held in the Atrium beginning at 3:30 P.M where the Judge will be available to interact with students and take questions prior to the discussion to follow.

The Curious Role of the D.C. Circuit

REBECCA J. HUSS, PROFESSOR OF LAW, joined the Valparaiso University School of Law faculty in 1999, and she has also served as a visiting professor of law at Notre Dame Law School, the University of Iowa College of Law, and most recently, Stetson University College of Law. She earned an A.B. from the University of Nort...hern Iowa, her J.D. from the University of Richmond in 1992, and an LL.M. in international and comparative law at the University of Iowa in 1995. Professor Huss served as an associate at Perkins Coie in Seattle, Washington, and Husch Blackwell Sanders, LLP, in Kansas City, Missouri. She worked as an attorney in the Animal Health Division of Wyeth. Professor Huss is a co editor of, and contributor to, ANIMAL LAW AND THE COURTS: A READER, and author of Rescue Me: Legislating Cooperation Between Animal Control Authorities and Rescue Organizations, 39 CONNECTICUT LAW REVIEW 2059 (2007).
In 2007, Professor Huss was appointed Guardian/Special Master of Michael Vick’s dogs. She is a member of the ABA Section of Business Law and is a vice-chairperson of the ABA TIPS Animal Law Committee.
