An artist has copyright protection in the United States and other countries as the author of an original work, such as a photograph. If the photo is less than 5 years old, the author can still seek and obtain an express copyright on the work. Check out the Federal law addressing this situation entitled "The Copyright Act of 1976", 17 USC 201(a). ... Read MoreThe general rule is that the author of the work owns the copyright. There are other rules related to work for hire, but that doesn't sound as if it applies in this case.
