I watch you on FOX News and I value your opinion! I am hoping that you can help me. I have sent emails and letters to senators, congress people, U.S. Government Health Resources and Services Administration, big government.com and the Office of Civil Rights. I have updated my myspace blog, facebook c...ause page and read more than I ever wanted to know about the over reaching power of the HIPAA Laws!

I would like to write a book dedicated to the “inmates” who lived, died and were buried without names on their headstones at Willard State Hospital from 1869 to 1929, to chronicle their lives for their descendants and for posterity. These people have been DEAD for 80 to 140 years. I am being denied these medical records because of the over reaching power of the HIPAA Laws. I need their medical records in order to gain the specific information I need. The detailed list would include the following:

1. Inmate's Name
2. Inmate’s Assigned Number
3. Birth Date
4. City, County, State, Country of Birth
5. Family Lineage (parents/spouse)
6. Date of Entry into Willard
7. Date of Release from Willard
8. Photos of the Inmate
9. Cause of Death
10. Date of Death
11. Burial Location
12. Detailed Map of the Cemetery with Correct Coordinates of the Numbered Burial Markers.
13. I am not asking to scan the records nor do I need the diagnoses of the inmates since they have already been marked on the United States Federal Census as “insane”.



I received a letter from the Assistant Counsel for the State of NY Office of Mental Health, yesterday stating that the Willard records will never be released unless I have a court order. I asked her to kindly answer my questions. Do you have any answers to my questions?

1. Does this mean that the 1100 inmates buried at the Willard State Hospital Cemetery in unmarked graves will never be identified because of the over reaching power of the HIPAA Laws? If this is happening at Willard, it must be happening all over the country which would also include orphanages with children in unmarked graves.

2. What are the HIPAA Laws doing to protect living American's medical records from being posted on the internet? Everyone knows that once an electronic document is made, it can be hacked and once it is put on the internet, even if posted securely, it can be hacked.

3. The HIPAA Laws are unacceptable the way they are presently written. There should be an amendment stating that if a medical record has survived 72 years, it should be available to the public. It should also state that living American's will have the right to opt out of having their personal medical history placed in an electronic database.

4. If I obtain a court order, will I be given the right to obtain the information that I need from the medical records of Willard State Hospital inmates?
