The House of Representatives passed SB 1004, the anti-deficiency fix, early this afternoon with a vote of 53-0. SB 1004 included the repeal and replacement of ARS§ 33-814 essentially returning the statute to its original status prior to the passage of SB 1271. With this fix, Arizona will continue to operate as a deed o...f trust state with the protections that have been in existence since 1971.
SB 1004 did pass both the Arizona State Senate and House of Representatives with an emergency clause, and it will go into effect upon Governor Brewer’s signature. AAR will continue to work with the Arizona Bankers Association on language to address “speculative builders” in the upcoming session in order to resolve this issue entirely.

Anti-deficiency law update: SB 1004, which will repeal the changes made to Arizona’s anti-deficiency statute during the regular legislative session just passed the Senate by a 22 to 1 vote. The House vote should take place today. HB 2008, which also repealed SB 1271 and its change to the anti-deficiency statute was... passed in the last special session, but the Bankers Association filed a lawsuit contending the repeal was invalid. If SB 1004 receives full approval the argument that the previous repeal was invalid should be moot. Tom Farley and Meghaen Duger are at the Capitol now to make sure that the legislators understand the importance of this issue.Read More

Correct me if I am wrong. If this bill passes, wouldn't people (homeowners and Investors) just go into bankruptcy. If they go into bankruptcy they would not have to pay any of their debt. Therefore would it not effect the credit card industry, auto loans..........looks like a dominos effect to me.

This is confusing. Is the legislature trying to enact a law to do away with the current anti-deficiency law like they almost got through previously? I am assuming SB 1004 & HB 2004 will keep it "Anti-deficiency" since AAR's lobbying effort is supporting them. Tom Thanks for your update and effort.

Michelle Governor Brewer has included SB 1271 and its change to the anti-deficiency statute in her call for special session. AAR has been working with legislators and industry stakeholders to address the Banker's Association's legal challenge to HB 2008, which repealed SB 1271 retroactively.
