نادي قضاة لبنان:
عملا باجتهاد الهيئة العامة لمحكمة التمييز
لا حصانة للوزراء في جرائمهم العادية أمام المحقق العدلي،

يذكر نادي قضاة لبنان، مجددا، بالاجتهاد الصادر بتاريخ 27/10/2000 تحت الرقم 7/2000 عن الهيئة العامة لمحكمة التمييز، والذي حفظ اختصاص القضاء العدلي لملاحقة الوزراء (نرفق ربطا القرار).

بناء على ما تضمنه القرار المذكور،

ولأن قتل المواطنين العزّل (القصد الاحتمالي) أو التسبب بقتلهم لا يمكن أن يدخلا بأي شكل من الأشكال ضمن نطاق الأعمال الوظيفية للوزراء، فكل منهما جرم عادي،

ولأن القضاء الجزائي العادي، المحقق العدلي، هو المرجع الصالح لملاحقة الوزراء والتحقيق معهم في حالة الجرائم العادية،

ولأنه بمقتضى المادة 60 من قانون أصول المحاكمات الجزائية، لقاضي التحقيق، المحقق العدلي، صلاحية تحريك الدعوى العامة بحق كل من يشتبه به، دون حاجة لادعاء النيابة العامة التمييزية،

يأمل النادي من المحقق العدلي العمل وفاقاً للاجتهاد المذكور والمضي بتحقيقاته حتى النهاية ضناً بحقوق الضحايا ومنعاً من ضياعها، لا سيما في ظل عدم تكوين المجلس الاعلى لمحاكمة الرؤساء والوزراء حتى الآن وصعوبة إن لم يكن استحالة تحقيق أي ملاحقة من قبله في ضوء الفساد السياسي والاقتسام الطائفي القائمين في البلد وخلو ارشيف مجلس النواب من اية ملاحقة.
