Not surprising as the 9th Circuit still has a roughly 6 to 4 progressive majority. This case is likely going to progress towards SCOTUS. No matter what the initial decision is from the 9th Circuit, that decision will be appealed to a larger (en banc) panel. If we win, the state is unlikely to appeal to SCOTUS. In the more likely event that we lose at the 9th en banc panel, gun rights advocates will certainly appeal.
