Governor Cuomo signed New York's new spousal maintenance law on Friday, September 25th. The Temporary Maintenance provisions are effective for divorce cases filed on or after October 25, 2015, and the balance of the law is effective for cases filed on or after January 23, 2016.

The governor has not signed the new law yet, but is expected to do so in the next ten days. The bulk of the provisions become effective 120 days after signing, and apply to cases filed on or after the effective date.

Changes to New York spousal maintenance and child support laws are expected soon. Depending on your case, you may want to wait for the new law, or file your divorce now to avoid it.
