And our reporting Corum S first is my nuclear Energy Leadership Act. This is Co sponsored by 17 additional members our nation invented civilian nuclear energy but we have clearly seen our leadership diminished significantly in recent decades This bill will restore it by helping to develop a range of advanced reactor technologies that are clean They are safe and that are reliable We also have two bills that are related to carbon capture utilization and sequestration C US one is from Senator Manchin And several of us and then there's a second that is led by Senators Cornyn and Cassidy Suzi us I believe is one of our best options to reduce greenhouse gas emissions both here at home and really around the world. We had an opportunity to see some of that when we few of us on this Committee took took a trip through some Arctic countries but I think we know the potential of C us and how we can manage carbon. I'm glad to be advancing these bills Look forward combining them as part of an energy package on the Senate floor Another measure that I want to speak to briefly this morning is my American Mineral Security Act which responds to a very significant threat to our economic competitiveness and our National security. We've had a lot of opportunity to talk about that in this Committee but basically if you want an iphone, if you want an easy and electric vehicle, you want at a 30 - five or 20 - Two, you need minerals You just need minerals. They are the foundation of Modern society Of the future so if there was ever a moment to take decisive action I think it's right now. Just a few weeks after China implicitly threatened our supply of rare Earth elements Our bill has drawn support from nearly every member of the Committee in the past We've again been endorsed by important stakeholders like the Alliance of Automobile Manufacturers I think that this measure helps to to put us on the right track I would note that well, this is our first major business meeting that's focused on energy legislation this year is certainly not going to be our last I intend to have another markup focused on energy legislation, including energy storage most likely in September. I think we've seen a lot of interest in that we had a good hearing few weeks back but I'd like to to make sure that we're moving that through the pipeline as well We're also working towards A business meeting that's focused on land and water related measures we all we all know the success that that we felt when we were able to move through our Hundred and 20 - four bill package that became law in March. I think there's a lot more that we can do. We've got some. We've got some issues that we're working through but again that's something that I also want to see the Committee advance for today's purposes. We have a number of amendments to Fires a working quorum of seven most of those amendments have been cleared by joint staff, but a few will require debate here this morning I think that we can take care of all these amendments by voice vote and then turn our attention to the underlying measures Most of the bills on our agenda had been worked out and also can be reported by voice vote A few may need world calls and we'll deal with that as we come to it, but I do appreciate the cooperation of all members to move through this as quickly as possible. I know schedules are tight Wanna finish this business quickly this morning so once we've reached a quorum I'll ask that most statements be held until after votes are complete. So now turn to senator mansion for your opening comments as well Thank you chairman Murkowski and I wanna thank you for calling the first legislative business meeting of the Congress. We've got a full slate of bills before today's you've mentioned that represent a lot of good bipartisan work that will move forward the ball on our clean energy innovation agenda The chairman I have both expressed their desire to pass multiple energy innovation packages Today's markup is an important step in that process as everyone in this room is well aware. I've always supported all of the above energy strategy I've also been resolute and climate change is real and this Committee has responsibility to work towards all of the all of the above climate solutions Today this Committee will review legislation pertaining to energy storage solutions carbon capture solutions renewable energy solutions nuclear energy solutions, and energy efficiency solutions every bill before Today it moves us towards a cleaner energy with more and better solutions. I'm particularly pleased to see three bills that I've been a part of and introduced on the agenda today, including a number of pieces of legislation that Chairman Murkowski and I introduced together One of those is my Appalachian Energy and National Security Act with the shell, gas boom and growth in the production of natural gas liquids West Virginia and our neighboring States are well positioned to contribute to a renaissance of the Appalachian petrochemical industry I've talked Atlanta's Secretary Perry about the potentially catastrophic impact of extreme weather in the Gulf which is responsible for 90 percent 90 - five percent of the US ethylene productive production capabilities, the potential economic and strategic benefits of an Appalachian storage hub Secretary Perry has said a storage have an Appalachian would be a win win My bill directs the to take a hard look at those potential National and economic security benefits The Effect Act which a number of my colleagues have cosponsored, is one of the carbon capture solutions before to do it today and a critical step towards both effective and pragmatic climate solutions a contemplates, a full suite of carbon capture utilization and sequestration for coal natural gas, in addition to capturing C 02 straight out the ambient air Important it is aimed and getting some of these critical technologies through the Valley of death to commercialization and wide deployment around the country and more importantly around the globe In addition to the effect Act, we're going to be advancing Senator Cassidy's natural gas specific legislation and I'm glad to be in good company and recognizing the need for carbon capture and I look forward to working together to merge our ideas as these bills proceed with a robust funding that we need to really make these technologies come in place also These bills contemplate a number of projects and I will be continuing conversations around maintaining a strong Union presence We are also making progress in our bills to address critical mental import vulnerability. I'm proud to be a consultant and Co sponsor of the Chairman's American Mineral Security Act and I also I'm proud to have you as a cosponsor. My bill manager chairman the Rare Earth element, Advanced Coal Technology Act or react In the midst of a potential trade war and increasing and demand, I think these are Tommy important bills for us to be considering I deeply appreciate chairman He's dedicated leadership on nuclear energy which is why I was also proud to Co sponsor the nuclear Energy Leadership doctor Anita a nuclear energy solution. Bill nigga is an important first step towards preserving us leadership in nuclear energy as well as decarbonizing and manufacturing sector The bill This bill enjoys bipartisan support and I think that reflects the broad understanding of Further arvest in advanced nuclear capabilities moving forward we've also seen support from private investors and luminaries like Bill Gates I'll quickly touch on a few of our other members bills as well We'll be considering Senator King Security Energy Infrastructure Act today, his bill takes a step towards protecting ourselves from massive disruption in the case of a cyber attack as the ranking member of the Armed Services Cyber subcommittee. I'm all too aware of how real that threat Senator Hendricks Energy Technology Maturation Act, which would address a critical gap in federal support for new technologies, namely the jump from our National labs to the outside commercial markets where they can become the next solution In addition, there are eight bipartisan energy efficiency bills on the agenda today that would improve our energy productivity and the buildings and manufacturing sectors I've Co sponsored two of these bills with my friend, Senator Murkowski and Sandra hope both of these bills will improve energy efficiency in federal buildings and savings of taxpayers money Productivity of our appropriated dollars investing in energy efficiency is common sense and it's one of the most bipartisan issues before this Committee and I urge my colleagues to support these bills I'd also like to note that as we move this legislation forward is important that we engage with our Union friends to ensure the robust participation and demonstration projects created by our innovation goals including discussions around prevailing wages the country's clean energy innovation agenda must include all communities and stakeholders our nation's workers They're lifting to keep the lights on and our economy humming They are vital partners as we move forward in shaping our economy to one with greater efficiency, more reliable, affordable energy and lower emissions So we have some important legislation before us today. An important opportunity to move the ball forward on cleaner energy solutions I look forward to reporting the mouth Committee and with that madam chairman I'll turn back to you Thank you senator Mansion So as I noted we are meeting today to report 20 - two items. the short list was circulated yesterday. I understand that you senator Hirono have an amendment that you would like to speak to Yes man, I'm sure I'd like to I'd like to call up hero No Amendment number one to us 903 with the legislative counsel Cole number T 19457 is 903 includes multiple measures to promote advanced nuclear technologies including requiring the federal government to enter into at least one power Agreement with an advanced nuclear plant by 2020 - three to accomplish this goal to bill extends the premise permissible length of time for federal power purchase agreement with an energy supplier from 10 years to 40 years. However, this authority does not apply to nuclear power as the intent of the bill might suggest. My amendment would allow the 40 -year federal contracting authority to only apply to new new power sources placed in service after the start of 2019 plans to Four 2019 will continue to be eligible under the current 10 -year limit. 40 -year contracting authority is a big change and this Committee should talk through the implications of a change to 40 years before making such a change. We need to recognize that the Trump administration has already tried to stretch existing authority to support old coal plants and others that are struggling to compete in the power market. The Federal Energy Regulatory Commission unanimously rejected the To bail out existing plants in 2017 and the second attempt by ideal seem seem to fizzle out last year the point remains that this Committee should think carefully how we can support energy innovation with federal power contracting and how that too could be used by the administration now and in the future I recognize some power projects need a longer time commitment to move forward For example, I introduced a bill in 2015 to allow the federal government to sign 30 years X for renewable energy and coal generation projects to recognize the support needed to get innovative projects financed and built We do not yet have a congressional budget office estimate on the cost of the underlying bill, which could inform how we should set the federal power purchasing authority They're also maybe other committees that may have important views to consider giving the interest of the general services administration and the Department of Defense have info power contracting I would like to have Show your commitment to work through my concerns on giving the federal government a blanket 40 -year purchase authority and develop improved language before us 903 or any other vehicle that carries a power purchase agreement is passed on the Senator Mansion Sarah Heroine. I wanna thank you for some incredibly important information and points you've made in this section of the new Energy Leadership Act that requires our careful careful consideration and you certainly have my commitment to work with you and chairman Murkowski to find solution to the issues you've raised as soon as possible It's important. I think very important long term purchase power purchase agreement, provisions of the bill reflexes intent to spur innovation and not saddled the basically and user with higher cost and we can't That must they have certainly there's gonna be gold at the end of the rainbow the advantage of long term power purchase agreement provides for advanced reactors is that both the demonstration and commercialization stage. It improves the financial viability of such projects which are vastly needed So I am totally in agreement with you I wanna work with you and I give you my commitment to work with you and Senator Murkowski to find a solutions to the concerns you've raised Thank you senator You've been a good partner on this I'm pleased that we've been able to elicit such strong bipartisan support for the bill US leadership in Advanced Nuclear will help our National security while putting us on the leading edge of technologies to help reduce global greenhouse gas emissions power purchase agreements. I think are important tool that can help deploy new and innovative technologies or attend our intent with this provision was to extend this authority in a technology neutral manner so that renewables could also benefit so senator on our Youtube You have my commitment that we will work with you as this bill moves to the floor You raise some some good concerns and we will be working together to help with this. Thank you very much for both of your commitments and I will look forward to working with you and senator mansion and at this time I will view of that withdraw my amendment Thank you senator and I know that you you've got our commitment here in in working on this next is agenda item 17, which is my critical minerals bill It's my understanding that Senator Hendrick has an amendment that he would like to discuss and then withdraw Senator Hendrick I would call up Amendment number one to item number 17 and my amendment would add the text of S 1380 -, six senator Udall's, hard rock mining and reclamation act to this bill and one of the things I would do is address the issue that Senator King brought up. I This amendment today but I wanna make clear that we cannot wait any longer to fix our hard rock mining system on our public lands and we certainly shouldn't be looking for ways to expedite permits within a system that is broken as this one is our current federal mining law was written in 1870 - two that is 140 - seven years ago. It charges zero royalties Minerals that belong to the American people It provides no mechanism to clean up old minds that that continually pollute our rivers and streams and it provides no way for communities to identify those places that are simply inappropriate places to develop a mind If you mind Cole you can ask ranking member mansion about this. If you mind cold that is owned by the American people you have to bid on a leash. You have to pay a realty and you have to pay into a fund that cleans up old abandoned coal mines, man hard rock mining Does none of this and we see the consequences of this policy every day is abandoned mines throughout the West leak hazardous chemicals into our waterways Sometimes that pollution is highly visible as it was with the Gold King mine spill in 2015 that turned the San Juan River in Northwest New Mexico fluorescent orange But even when we can't see it old minds are leaking toxic chemicals into our rivers every single day we have an Estimated 500000 abandoned mines in the West that represents tens of billions of dollars of cleanup costs We simply can't sit and wait for this problem to get even worse Now, I appreciate the importance of critical minerals too much of the technology that we rely on and I appreciate what senator what chairman Murkowski is trying to accomplish with this bill but I Cannot support legislation on Rock mining until we finally fix our broken mining policies We need a hearing in this Committee on minor form and we need to move the hard rock Mining and Reclamation Act because every year that goes by without action this problem simply gets worse I'm not gonna ask for a vote on this amendment today but I would ask that the chairman, the ranking member and my colleagues work to move this critical legislation through the Committee in the coming year Thank you I cannot agree more wholeheartedly with you until I became a member of the Senate, I had no idea that there were other methods of mining that were not as controlled as the methods I've grown up with I knew what happens when you have a bad mining practice when there's no oversight or controls, there's no water controls. There's no emissions There's no reclamation and to know that something is going on for A hundred and 40 - seven years and no one 's put Even ask questions after the Clean Water Act pass after the Clean Air Act fast and we've got a living crap beat out of us for everything that we have done an energy we provide for this country and we've tried to do it right and continue to even do it better than we've ever done it before It is long past due and you have my wholehearted full throttle commitment to help you bring this into compliance with what everyone should expect in this great country The American people have been short changed on this They get no royalties whatsoever They pay no fees whatsoever I cannot believe that we've allowed this to happen but you can't condemn the past but we can fix the future and I I commit to work with you Senator Madam chair. Thank you so much I thank you when ranking member mansion for working on this important issue when I do support my colleague from New Mexico on this issue and commend him and senator ukulele on Congressman Graham overall their work on hard rock mining. So look forward to working with you in the future that I do appreciate the chair and ranking members work on critical minerals cuz they do play a vital role in many of the areas of our economy particularly in the transition to clean and efficient renewable energy these men Are essential to a host of technologies from cobalt to lithium to photovoltaic cells to rare Earth metals in magnets and use in various clean energy like wind turbines and electric vehicles so they make our products more efficient. They lower costs and a better performing. So I support many aspects of this bill However, I am concerned about the unwanted provision that would exempt hard rock mining from bedrock environmental protections and limit the public participation in the permitting process metal Mining in our country is the leading industrial polluter and according to a government document, just 40 minutes will generate an estimated 17 to 20 -, seven billions of polluted water every year. So given the great impacts of the mine operations on the whole, I believe sufficient environmental review of project is not just warranted, but will immediately lead to cost savings for our citizens in the area of health and ecosystem, so these I've been part of various discussions in Congress and I hope that we can do as this process moves forward is keep in mind that a 2017 report found that the primary cause for permitting delays is the poor quality or lack of information provided by the project. Proponents not complying with existing environmental law so we need a 20 first century hard mining program that fairly compensates taxpayers where the use of these resources and ensures that there is a strong Nation standard in place to keep our community safe so I'll continue to work with our colleagues on these issues as we have concerns about this item and the agenda item overall Thank you madam chair Thank you Senator Cantwell and I appreciate your offer to to raise this issue and withdraw at Senator Hendrick. I think we we can see from members that there is a desire for further consideration of that and you've asked for my commitment to to do just that to provide that consideration that Something that I believe is separate from what we're doing with our critical minerals act and I'd like to be able to move that I'm told that I'm gonna have at least a couple members on my side leaving at 1030 So I would like to get to the votes. I know Center stephano you have asked to be recognized if you can be very brief so that we don't lose these folks that are heading out the door Thank you madam chair and I I did want to briefly respond in indicate just why at this point I will be voting no on this provision but also at the same time Center Hendrick I just think as a general rule anytime there is a law that hasn't been revisited since 1870 - two probably common sense says it be good to updated ready but I I I wanna thank you for raising the profile and the importance of addressing critical miney needs and I know that this is important to us with advanced vehicles and I and I want to I wanna thank you for that. There are number of issues. I won't go through them that I strongly support in this bill but I That my principal concern is that I don't think we can conclude that streamlining environmental permitting on federal lands will necessarily result in increased domestic production of critical minerals because we are competing with China. And when we look at the factors that China is involved in most notably heavy government subsidization this does not really address the way we are competing with China and second I'm not sure we should use the streamlined environmental permitting process for roads and bridges at a model as a model to streamline permitting for mining on federal lands because the environmental impacts on mining projects are vastly different and finally, I just wanna know in ask for your commitment to work with Senator Roberts and I'm moving forward There are major implications for National forest land. We share jurisdiction the agriculture Christian and Forestry Committee shares jurisdiction on this and we would like very much to work with you and follow up on the floor. I asked people to support Thank you Senator King I understand Senator Cassidy's arguments and certainly understand Greenhouse gases but it concerns me that we continue to approve Ellen G Exporting the allergy exporting program as it approaches 50 percent of daily production of natural gas which I think inevitably will affect domestic prices here in the United States will affect manufacturers. It will affect consumer so respectfully I have to I'm gonna vote no on this I think the company should consider some way of Exports whether it's by an absolute number by a percentage but to allow this to continue without controls. I think will lead us to a a catastrophe of gas costs in this country. Madam chairman briefly respond very breezy Yeah, we've we burn and flare more gas right now then this will export and so the question I disagree strongly with what Senator King said. I think that supply is tremendous. We cannot repeal the law of supply and demand in this Congress All I will add to this debate We're debating here amounts to zero point 17 percent of total natural gas production that we're talking about it applies to exports up to 50 - one point 75 billion cubic feet per year. Two energy related bills is is really quite a significant accomplishment. I think if you look to the details of what we have just moved out of Committee there is a great deal of substance whether it's what we have advanced with with nuclear energy and the leadership there whether it's the measures on efficiency whether it's Minerals it is I think it's significant that once again as a as a Committee that just kinda puts our our shoulder into the issue working in a constructive way and I know that there are no members here right now where I can say thank you to them on for their bipartisan work but we know that this does not happen. You do not move 20 -, two energy related bills through Committee like this without Work of the staffs on both sides with the ranking member and with my team as well as with everyone else's staff. So I know there has been a great deal of hard work and effort that has gone into it and I wanna thank my folks. I wanna thank Senator Mansions folks and the the the staff on all of the members teams because you have truly made the difference once again.
