I've watched and under my direction, the Commonwealth will be will be pursuing three different charges of assault and battery against Officer Timberlake as a result. Ephesians 30 - six months incarceration. I can assure you that I following this case closely ensure a thorough the the prosecution and outcome, especially these trying times. We can can all agree footage this is unsettling. I'm one of our community to know that we are pursuing charges that in line with current law and supported by evidence, which with which we have been presented. However, I also appreciate that this Reconcile feelings about what we see, I can tell you three important things. First. we will Justice in this case as we we do in all our cases with our community values Front Center. Second, I overstate the value and role that the value of the role that body cameras have played in our investigation into this We're fortunate that this technology use in the region of County in which this occurred without it. For almost 80 years, the Fairfax County Police Department engaged with its diverse community to Co policies policies and procedures meet the values of our community and exceed the standards of our profession 1989. I've member of the Fairfax County Community and I've proudly serve as a police officer and now as the chief of police, our vision and mission clearly States that we. The sanctity of all human life, is righteously angry at the law enforcement as MI. many are not engaged with their communities. The Fairfax Police Department is with its communities and we value transparency accountability and as evidence by our civilian panel and our independent police auditor those values. Held to the standards of our community members who this systems, the body camera video that that observed and I am releasing shows a Fairfax County deploying force violation of our use of force policies and and they aren't acts, which violate our oath of office and they ignore the sanctity of human life. The video also. The trust of police officers not only in Fairfax County, but throughout this world, acts are unacceptable. The victim in this video was treated at a hospital and released. I thank God through my prayers that he is alive and resting at home with his family. I've personally reached out the victim and spoke with his mother to express my disgust with my officers. Acceptible criminal actions and assured her Justice will served. I continue to offer my prayers victim and his family. I plead with our community understand they are seeing transparency and accountability, and I will ensure that the police Department serves Justice in the best way we can for that accountability and transparency in addition to the. Investigation I have launched an administrative investigation, the use of the horrible use of force shall be subjected to review by the Fairfax County Police Auditor The officers on the scene of this event have all been duty pending the outcomes of both the investigations. The officer who committed these acts. Tyler Timberlake, an eight-year affection of this Department, the officer. Relieved of duty and his law enforcement authority in accordance County regulations. I will will move swiftly with administrative investigation to make the the legal determination among personnel regulations. as to the officers employment. It's important to note that I need to abide by those personnel as I do have to follow due process in accordance with these regulations and the law. As a a community and engagement, We shall heal heal our and hold everyone accountable and now is the time for healing, especially after horrible event, where we as a Fairfax County Police Department engaged with all of agencies and our elected officials are one Fairfax and this is behavior. We shall not tolerate. Continue for the victim, his family, our community and this nation. There brave women and men in law enforcement who their noble calling in life and they have goodness in their hearts to protect the sanctity of all human life. This has been a particularly hard couple of weeks for Fairfax community and what we've heard tonight make hearing much more difficult healing much more difficult. The Department has come a way to further our values, including the establishment of a civilian panel hiring of an independent auditor phasing in body warn cameras of which we saw the value of here tonight and currently studying racial disparities use of force cases by FC PD. Clearly, there's still work to done in community. The board will be joining chief as we always do in tough but needed conversations with our community and our police Department to make sure. County continues the progress that people expect when it comes to actions and community This conversation is far from over as a country and as a County County, must heal together. healing only begins only begins when difficult had. the responsibility is ours to rebuild any trust that has been broken with this incident, the victim and the victim. For depicted in the initial comments of the officer on the scene, so what we saw was of the call. call. There wasn't any other acts by by the victim by the individual in their prior to body camera being the body giver. This gentleman having some type of episode and I applaud the first officer on the scene, especially with paramedics and the firefighters. What you see there is what we trained for in Fairfax County and throughout the Progressive departments across this that's the escalation that was the value of the sanctity of human life. They were working with this gentleman get him help to the ambulance that was very clear and unknown reasons right right now. we have to wait for criminal investigation investigation and investigation understand what was in in the mind this officer officer to do what he did that was deployed at electronic control weapon escalate unacceptable. I'm just disgusted a lot of these. The laws are being reconsider and rewritten as far as other officers. Bystanders and how they have to interact. Can you talk about that? and you say the the other officers have been relieved duty and how they could have how they should have reacted in your your opinion. We're co-produced with our community members to a Adcock Commission, and we continue to use that Co production model to have community input on our use of force policies and most every other. That we have that's not driven by a law mandate, so we have changed our use of force in 2016 through that Co production model also learning from police So what you see is unacceptable. It does not value the sanctity of human life. so to your question I have to through administrative investigation. I have a policy of duty to intervene. Most departments across this country, I challenge my peers. they need to step it up and that duty to intervene in that's a question that I will answer through the administrative processes whether or not they could have been intervened faster. I don't don't have an right now, but we do have a policy that there is a duty intervene. It sounded like Timberlake was saying name while while he on the ground with the victim was he speaking to the victim by neighbor, was he speaking to his. Did you that individual prior I I will assume he was speaking to the here and I have to administrative investigation to make sure make sure that's 100 percent but based upon upon what know it was directed towards the that officer does he generally patrol in that area and work that neighborhood that he was in there, the officers assigned to the district station that covers that portion of Alexandra that officer officer is obligated by working at area to know that area the force used to. Him down is that part part of training we've heard so much about a knee to the neck and the back is that the the proper technique at this point force, we have a prescribed policies escalation and de-escalation, and it's only that amount of force necessary overcome resistance. so I need to answer to my own administrative investigation separate from the criminal investigation, whether or not those tactics complied with my policy based upon the res. Offered clearly, I've been transparent to release this video but please I I ask the community to wait because we need interview all the officers and to determine of how much pressure was used and get the answers each individual to develop the full story. and that's what the investigation is about, but we do hold accountable for the application force just because you escalate does not mean you continue escalate. you have a duty to deescalate that's prescribed in our policy and all was. Will be subject to that scrutiny. That's two more questions Chief given everything that's going going on in country right now, everything that's going on for this why should African-Americans people of of color Fairfax County Department this erodes the trust that this unacceptable action and I I righteously stand with the anger across this country in this community because I have righteous sanger too. This is unacceptable. I'm a chief of police. Need to hold the officers accountable to community holds me accountable, and we do a better job as a profession. As the chairman mentioned, we do have a study underway by the independent police auditor because when you look when you look at Fairfax County's use of force data it is just proportional to the African-American community and we investigate every single use force as as an everything above a guide and escort, it's documented and reviewed some of my peers across this country. don't have that level of. And we've made that data transparent and I welcome study. However, we know from the data collection on this issue of disproportionality of force, which I sit on the the National Committee. We a problem in our profession. We do disproportionately use force in the African-American community and to understand why I'm not casting any decision that. but we here in Fairfax County are studying that to understand how can we do better last question? Timberlake and what can you tell us about his record of service any complaints or issues that you know of or that have been brought to brought to attention by by law.
