In considering what order, if any, should be made, the Court takes into account:

1. the financial contributions made directly or indirectly by or in behalf of a party to a relationship or a child of that relationship, to the acquisition, conservation or improvement of any property of the parties to the relationship or either of them, or otherwise in relation to any other such property, whether or not the property since the making of the contribution ceased to be the property ...of the parties to the relationship;
2. the contributions made by a party to the relationship to the welfare of the family including any contribution made in the capacity of homemaker or parent;
3. the effect of any proposed order by the Court upon the earning capacity of either party;
4. matters relating to the financial support of the parties.

When considering the nature of the well-being of a party to a relationship, the Court will take into account the age and state of health of the parties; the income, property and resources of the parties and their physical and mental capacity to maintain or obtain gainful employment, and whether a party to a relationship has the care or control of a child of the relationship.

If only the separating adults could have such insight into what is best for their families. This 6-year-old child (going on 106) is so articulate about how she feels and can make us all understand what all children feel during a family breakup and divorce. If all of our children could tell us what they want, I would bet they would say it just like this little champion. When you think of the situation that you are involved in with your family problems, think of this girl and u...nderstand that that is what your children are thinking when they look at you and your partner. Your children want both of you equally in their lives. When there are children involved (even if not) it is always best to preserve relationships for their sake and yours. Remember you once loved and cared for your partner /former partner and that should mean at least a little. It means a whole lot to your kids and family. So no matter what has happened between you (except domestic or family violence) take the better position and keep it "low" as our little friend so beautifully put it.
