Quincy District Court – The officer testified that after the client entered a sobriety checkpoint, he was asked to exit due to his operation within the checkpoint. Prior to exiting, the officer stated the client's eyes were bloodshot and glassy, there was a strong odor of alcohol coming from the car and the client had uncoordinated movements, admitted drinking a “few” glasses of wine when asked and had slurred speech. The officer further stated the client was unsteady on his feet when getting out of the car, walking and standing and could not say the alphabet or count backwards as instructed. The officer testified that the client failed the walk and turn and one leg stand field sobriety tests. – NOT GUILTY

Two recent cases in Plymouth District Court:

Plymouth District Court – The officer reported that he came upon an accident and on approach, saw the airbags had been deployed and then saw a woman exit the driver’s side door yelling with slurred speech that she was fine. The officer stated she was unsteady on
her feet, had a bloody lower lip, was uncooperative, animated and agitated, smelled of alcohol, had glassy and red eyes and admitted drinking. – BAC 0.26, CASE DISMISSED


Plymouth District Court – The officer testified he was dispatched to the report of a motor vehicle accident and on arrival saw a vehicle completely off the road with heavy front-end damage and deployed airbags and a broken telephone pole. The officer stated the client
was alone, but denied driving, had bloodshot, glossy eyes, slurred and, at times, incomprehensible speech, smelled moderately of alcohol and had black dust and red burn marks on his inner arms consistent with airbag impact. The officer testified the client also
had what appeared to be airbag marks on his stomach, a mark on his neck from what he thought was a seatbelt and scratches and cuts on his knees and feet and fresh dirt on his shorts. The officer testified the client admitted drinking, failed the walk and turn field sobriety test, could not complete the one leg stand field sobriety test and could not count backwards as instructed. – BAC 0.21, NOT GUILTY

Massachusetts OUI District Courts

Hingham District Court July 2011:

Client is stopped for driving on the wrong side of the road for a 1/4 mile. According to the arresting officer client had bloodshot eyes, slurred speech and is unsteady on their feet, client also smells of marijuana. Client is asked to step out of the car and perform field sobriety tests, all which the client fails ...according to the police officer. Officer testifies client cannot hold leg up for more than 7 seconds and cannot walk in a straight line. After being placed under arrest, client is searched and located in his pocket was a marijuana cigarette. NOT GUILTY ON ALL COUNTS.
