HB 335, Illegal Activities on Trust Lands Amendments, makes peaceful... protest against clearcutting or strip mining on school trust lands result in charges so severe as to be unduly excessive for the crime being punished. A public hearing on HB 355, Illegal Activities on Trust Lands Amendments is set for Monday, February 24, 2020 in Room 445 at the Utah State Capitol.
Since 1895, Article I, Section 1, of the Utah Constitution, has protected Utahns' right to 'protest against wrongs'. This right to protest is an honored foundational pillar of every constitutional democratic republic. Now Utahns' right to protest on school trust land is under dire threat. HB 355 proposes severe criminal charges if a protest on trust lands, 'interferes with activities of a lessee" and causes a "pecuniary loss". Rather than protecting trust lands the extreme criminal penalties of HB 355 endangers peaceful protest with first degree felony charges, punishable by five years to life imprisonment, if a company claims a protest by three or more persons caused a financial loss of $5,000 or more. (See Group Enhancement, 76-3-203.1.) Our grandchildren of tomorrow will thank you for taking a stand for what is right today.
Ask your Representative and Senator to stand up for democratic principles and oppose HB 335.
