New York Law School Prof. Arthur S Leonard explains Lambda Legal's victory in a federal court in Idaho, where a magistrate judge ordered that state to issue new birth certificates to transgender applicants. The ruling, which found the existing failure to do to be discrimination based on sex, imposes a significant burden on the state in justifying any cumbersome requirements it might attempt to impose on such applicants. Idaho was given 30 days to comply.
