"The Times’ editorial board hasn’t questioned whether the crime was horrific or the sentence was too lenient; it was, and it is. Probation should be granted onl...y if it serves the best interests of justice, and it is extremely hard to conclude that the best interests of justice were served by this ruling. On this point, Dauber’s team and The Times’ editorial board strongly agree."

Critics say the latest case involving a Latino immigrant facing a longer sentence than Judge Aaron Persky gave former Stanford athlete Brock Turner shows bias toward the privileged, but others note key differences in the cases.

"At ‪#‎FVCKRAPECULTURE‬, GRLCVLT member Jennifer Johnson read a note from Dauber to the group. It explains how Turner’s privilege played into his light sentence. “If you were a poor or black or brown person who wasn’t a recruited Stanford athlete who committed your crime at a fraternity party, the expected sentence is four years.”

Dauber’s letter also thanks everyone who attended #FVCKRAPECULTURE:

I’m so thrilled that you’re having this party to support us, each other, and survivors everywhere. Today, we live in a society where you can get a longer sentence for tampering with a fire alarm than sexually assaulting an unconscious young woman in the dirt next to a dumpster. It is time for us to say that enough is enough, we’re not taking this anymore, and we’re not accepting this."

David Palumbo-Liu, a Stanford Professor, weighs in on ‪#‎JudgePersky‬ and the bias he has shown on the bench. If you agree that we need to ‪#‎RecallPersky‬ - sign up at recallaaronpersky.com.

"The road to reform that protects the rights of all of those caught up in the criminal justice system – men and women, white and nonwhite, poor and privileged – has to be a willingness to root out bias wherever it exists. Turning aside from a commitment to fair enforcement of the law does not make sense. What is needed is a careful attention to where it goes astray and transparency in the process. In this, Persky failed and should be recalled. We need to learn from this, and be willing to play our part through enforcing accountability through democratic processes. We should recall Judge Persky and should replace him with a judge who is not biased."

If we’re going to make rulings on a case by case basis, then judicial discretion can only be entrusted to judges who will use it fairly – and Aaron Persky clearly can’t

In a recent poll of Santa Clara County voters, 77% agreed that if ‪#‎BrockTurner‬ had been Latino or African-American, the sentence would have been tougher. Today that is abundantly clear. ‪#‎JudgePersky‬ handed out a 3-year prison sentence to a low-income Latino defendant charged with very similar crimes to Turner.

Breaking News: Judge Persky approves a sentence of 3 years in prison for a low-income Latino defendant charged with very similar crimes to Brock Turner. Like Turner he had no serious criminal history. Unlike Turner, the Latino defendant was extremely remorseful, apologized, admitted it was wrong, and pleaded guilty.

"Michele Landis Dauber, the Stanford professor leading the recall, said the Ramirez case was further evidence that the judge should be removed. “This just shows ...that our concern about Judge Persky’s ability to be unbiased is justified. We continue to think that he abused his discretion in giving an unduly lenient sentence to Turner,” he said.

Ramirez’s three-year deal “shows that Turner got consideration not available to other defendants who aren’t as privileged,” added Dauber, who is also a family friend of the Stanford victim.

ICYMI: Judge Persky ran for election based on a promise to treat rape seriously. He wanted women's votes when he ran as a "get tough on rape" candidate. When a candidate runs for office on a platform, voters are entitled to evaluate whether or not that elected official has lived up to his own promises. It is hypocritical to run based on commitments and then claim that the voters cannot evaluate those same commitments.

Years before Judge Aaron Persky let preppy rapist Brock Turner off with a lighter-than-light sentence, he bragged about prosecuting sex crimes.

This is a must-read from the Mercury News written by Mark Lemley, a Professor at ‪#‎Stanford‬ Law School.

Lemley outlines why we must ‪#‎RecallPersky‬ for his unreasonably lenient sentencing of ‪#‎BrockTurner‬.

"But Judge Aaron Persky must take the lion's share of the blame. To sentence Turner to only six months in jail and then probation, Persky had to cite "extraordinary circumstances" that make this case much less worthy of condemnation than others. He clearly sympathized not with the victim but with the defendant, a Stanford athlete. That's not acceptable."

The author argues for recalling Judge Aaron Persky because of the Brock Turner sentence, as a counterpoint to retired Superior Court Judge LaDoris Cordell, who opposes a recall.

ICYMI: Channing Tatum spoke out against ‪#‎JudgePersky‬'s lenient sentencing of ‪#‎BrockTurner‬.

“I just couldn’t believe it. It’s like if you killed someone and got caught red-handed and just because you went to a nice school, and you were a good swimmer, you somehow get a lesser sentence. That just doesn’t make any sense.”

Professor Michele Dauber responds to recall critics in the Washington Post:

"In [recall opponents'] superheated rhetoric, this orderly democratic process of gathering signatures, filing petitions, and voting governed by law is a “lynch mob.” O’Connor’s view would bar voters from considering judges’ actual decisions, no matter how biased or arbitrary, when voting on a judge.

Would [opponents] make the same argument if the violent crime in question were based on the race, religion or sexual orientation of the victim? This is a radical idea that would leave judges completely unaccountable to the voters. They are certainly entitled to this view, but it is flatly inconsistent with California law."

Women have historically used the judicial recall when judges refused to take rape seriously. We are simply following in the footsteps of past generations in saying enough is enough. Judges are accountable to voters in California. Hold ‪#‎JudgePersky‬ accountable.
